I know this isn't how the law works, but it would be funny if the Completionist could sue Karl Lobst following the exact same arguments Karl makes against Billy, because under those Lobst would be guilty of defaming the Completionist.

• (1) Publication: Lobst's videos
• (2) Falsity: No charity funds were embezzled
• (3) Fault: Applying Lobst's arguments, the Completionist is a private person for the purposes of defamation, so Karl must only have acted negligibly, which he did (AccountingAndYouTube tried to correct Lobst but he continued his defamation)
• (4) Defamation per se: Again following Lobst's logic, the fact that he accused the Completionist of charity fraud alone qualifies as defamation

Jobst used to be good at collecting and presenting information even outside of his specific niche. Sure it was a bit regurgatory, but it was presentable for both normies and people actually invested. He used to be clear and concise with both the story and the technical aspects.

• Have to take care of family and appease wife
• Can’t make too much because then assets won’t be protected and he’ll have to pay back the settlement.

I think Lobst could probably find a way to pay Billy back at least some of it. He could also probably get to a settlement with Billy, but I don’t think he’s willing to deal with the terms of it.

If I was Billy, I’d settle it under the condition that Lobst has to include a statement at the beginning of every future video he publishes on any platform saying, “Billy Mitchell outsmarted me for shamelessly lying about Apollo Legend and deceiving my fans.” He’d also have to fork over 50% of all future sponsorship payments, which I’d use to buy a plot of land near where Lobst’s kids go to school and put up a massive billboard with rotating Lobst memes.

TLDR
90% chance of being dismissed. The main reason Karl's arguments are considered weak is that he largely repeats his original allegations instead of directly answering the legal defects raised in Billy Mitchell's motion to dismiss. Karl does not seem to know what court he is in. Citing caselaw from other states, for example citing anti-SLAPP statute from Georgia. The lawsuit is in Florida Karl which has different anti-SLAPP laws.

I am aware caselaw from other states can be persuasive, but Karl cites non-binding or unrelated authorities while overlooking controlling Eleventh Circuit or Florida authority. It kind of like saying, I don't want the court to follow the case law from the state it is in, instead, I want to follow another states caselaw because it says what I want. Karl, you are not persuasive at all.

We still never received a proper answer about the golf event money (even in both of Jirard’s big comeback responses) which was a big concern since the Open Hand Foundation were only putting the money they earned from the Indieland streams on their taxes.

Jirard’s super lucky this didn’t happen a year after it did because we would have had access to Open Hand’s 2023 tax filings and would have been able to calculate the exact amount earned from Sponsors at the PBD 2023 golf tournament.

Dunking on Karl and Muta is good ol fun but it shouldn’t give leeway to bad parties like Jirard. If anything, it’s a good example of why incompetents like Karl and Muta shouldn’t involve themselves in situations like this. When they lose their credibility, it muddies the waters in spite of what evidence is present (and there was a good amount present of Jirard).

I still don’t believe Jirard was ignorant of what was going on. His dad’s office was in the same building as the office for That One Video Gamer (which his dad probably helped him get), his brother was working with both him and his dad, etc. Even if Jirard has daddy issues, like he said in one of his responses, he was still tightly knit enough for his dad to be involved in his business ventures and vice versa.
