Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

"I'm not feeling so good Vic sisters..."

Feels good to be vindicated after years of hearing you guys cope here. I was a Vic stan in the beginning. But by the end I'm enjoying the cries of all these nerds left holding an empty bag, after Beard and Nick have run to the hills. Maybe they can hide their ill gotten gains in a trust like Vic did?
:story:

Well damn, I didn't even realize the appeal was in legal limbo for 2 whole years now. I joined KF by sheer coincidence since Rackets who I stumbled upon randomly kept referring to it while talking about this case.
Considering I'm not an anime autist or Vic fanboy, I can't even recall how I ended up watching it.

Regardless, it was at the time all this culture war shit went in full swing and dudes were being cancelled left and right by shameless whores. Desire for justice made me invested in the ongoing ordeal for a while, and there were a lot of lulz to be had.
Since they lost the case, I stopped paying attention. Now that the appeal fell through, I'll say the same thing I said back then. At least Vic got to make his case, that's more than most who ended up in similar circumstances could say. It wasn't a one-sided battle and he wasn't fighting it alone - that matters. He's in a better place now than he was back then, with the possibility of having a normal life instead of being an outcast with no career prospects or outright dead, which is what his detractors wanted.
They can gloat all they want, but they'll be as miserable as ever, while Vic moves on to better things.

In the name of the flamboyant pants, amen.

True, the case didn't go as well as it should have, but it did clean up Vic's image enough for him to start getting roles and invitations to cons while Rial and other gaslighting POS are now seen as, well, gaslighting POS.

As far as I'm concerned, Funimation never got and never will get a dime from me.

Lost the battle, win the war I say.

Vic admitting to touching Marchi's hair really hurt him. This is compounded by the fact that his unsworn declaration was deemed too late to be considered.

TLDR: Not a false statement of fact, and since the court deems Vic a public figure, he did not show actual malice.

For Rial:

Again, those late unsworn declarations look like they would've swung the case the other way, but Ty was too late.

Also, in her deposition Monica claimed her statement of "he's the definition of harassment" was a typo and should have read "here's the definition of harassment [insert definition here.]" Vic didn't rebut this.

For Funimation, Vic couldn't establish actual malice

For Ronnie boy, the court said Toye's tweets were too vague to be considered defamatory and even then Vic did not establish actual malice.

Nooooo! The year of the Chud momentum!

Sadly I think we will have to cut our losses on this one. Just goes to show that you need to dot the I's and cross the T's when you are a lawyer.

I still like Ty Beard personally but I will admit he screwed up. Then again, I can understand being buffalo'd by Chupp being a dumbass.

It doesn't matter though. The one guy I personally knew that cared about this died so I won't have to put up with gloating.

I'm feeling a bit vindicated cause when I first showed up here and said Ty royally fucked Vic I got told it was all that idiot Chupp's fault and while Ty is a fuckwit the appeals court loves to slap Chupp down and it'll be no different here cause muh law. Sucks Vic's life is royally fucked and for those who are like Texas supreme court it now Vic lost and was already in the hole for 500k and will now have to pay those fucks more money because Ty was too busy stroking his ego and sucking up all that fame to properly file the document with all the critical shit in it. If Ty got that amended petition in Vic probably wouldn't have gotten blown the fuck out like he was on a Sabat casting couch. I hope Vic slaps a malpractice lawsuit across Ty's fat face. Will be hilarious to see how Nick manages to spin that.

Hope Vic doesn't minecraft himself.

:edit:

Chupp's dumbassery has no fucking impact on Ty's pure incompetency on the job. How the fuck do you not get something properly notarized and filed in time? That document had the smoking gun and it couldn't be admitted because Ty and co fucked up. That's on Ty not Chupp. Vic needs to fucking sue the fuck out of Ty. I hope he keeps his promise to momma Vic and retires.

Listening to Ty go ‘we only got the depos because I was a hard arse’ in light of the appeals coming back and saying he should of objected more just makes me ask how he made the fuckups he did. He knew objecting worked and just didn’t play into it.
If Ty got that amended petition in Vic probably wouldn't have gotten blown the fuck out like he was on a Sabat casting couch.
The appeals court all but said ‘we would have ruled in your favour if not for your lawyer’s colossal fuck up’ They went to pain staking lengths to drag Ty. It’s spectacular.

Última edición:
I've only followed this here and there, but every single time I would tune in, Ty would be drunkenly rambling about whatever on Racket's show deep into the early-morning and a few days later would just barely hit the deadline - or even miss the fucking deadline - on what seemed like pretty simple, routine procedure. Every single time I would look over to check in, it was the same damn thing.

What was anyone expecting?
I really hope people have learned to treat Rackets & Co. more as entertainers rather than anyone you should turn to for competent legal advice, representation, or hot takes. Just accept that competency and entertainment value are on a zero-sum scale when it comes to the law.

Fear the beard, huh.

At least Vick won in the court of public opinion. It's worth jack shit now that he has to pay an exorbitant amount of money, but at this point it's all about the silver linings.

Fuck whores, and boy are there a lot of them gallivanting about. No wonder these useless, fat slags of the western world are getting icreasingly bold in whoring about, with this system in place.

Unironically MRA.

Has any evidence of persistent or patterned sexual harrassment even been presented against Vic?

They try the reconsideration hail mary, it fails.

Chupp gets the fees thing thrown back in his lap.

Chupp, being a lazy retarded fuckwit, does the thing that requires the absolute least effort: Awards 100% fees for everything he's asked.

Vic goes back to rebuilding his career at his new studio.

Monica and Rial go back to the new Golden Corral since that one hasn't got them on the blacklist for abusing the all you can eat policy yet.

Ron goes back to touching himself while watcing old videos of the bull and Monica (she won't let him stay in the room anymore).

Well, Nick's main fuck up was recommedning Ty when he was out of his element in this case. But overall Nick has done a lot of good for Vic's reputation in general since he provided him with the PR he needed to weather this storm. I can't really imagine what would have happened without Nick's input. It would have been much worse and the other side woudln't have been exposed as liars to as many people.
For better or worse, Nick recommending Ty didn't result in a legal victory but instead a much more impactful PR victory, which is a little funny since Nick recommended Ty to Vic so he wouldn't just rely on what a PR team was telling him.

Whatever, anime is still gay and anyone who watches dubs is a moron, the very belated outcome of this case doesn't change anything.
