He was there on a civil case regarding a creditor. His words of I hope they try, or I'll kill them dead mean nothing, nor are they specific. This is only relevant if the DA decides to charge Fox for assault/battery. It is irrelevant in determining if Chud had a legitimate claim to self defense, since he was obviously trying to engineer the situation.
Fox posted his intention of wanting to kill him directly by name. If that's why he was there it'll look worse. Worse still given past history of violence.
Say Fox was there for a case too.
He's known to not discriminate against his target. If seen, and matched, then that's it. Has no altercations, either attacking or attacked, in the past. Has past history of words being used.
Fox has named him directly, indicated wanting to kill him, and that makes it premeditated given the intent. If seen will seek him out given intentions are known plus has history of violence.
Whose starting to look like the agressor there?
A:B | Approach > Words > Punch > Shoot
B:A | Approach > Words > < Words > Punch > Shoot
Passive, doesn't know Fox, gets punched
Active, does know him, and punches
Who agressed whom exactly
Any reason to believe that if Chud hadn't shot Fox he would have possibly killed Chud
Fox will also have the fact he failed to calm down over the time he had since not in the heat of the moment
