Well, I am sorry to say, it is no longer proper to call him a twice- or thrice-declared vexatious litigant, because he has lost his appeal in the 9th Circuit. With the court's ruling affirmed, David Stebbins is now officially and unequivocally:

Stebbins was already subject to the filing restrictions the order imposed, so this does not change his ability to file cases. However, it does finalize the issue and prevent him from claiming the Northern California vexatious litigant designation will likely be overturned on appeal, which he has repeatedly claimed since the original order.
Stebbins already requested rehearing and en banc review (also attached), which obviously will not happen.
And be sure to wish him luck in the future, as he seeks to have this reheard en banc, and also works on earning his fourth vexatious litigant label, in West Virginia, in a case where he is suing the Kiwi Farms.
