The 10th Circuit holds that the answer is no, however the result might have been different if the woman had locked her door instead of leaving it unlocked.

"Disorderly Conduct" shouldn't even be a thing. It's a catch all charge that can fit literally any situation and is incredibly abusable.

If someone hits someone charge them with assault, if they break something charge them with destruction of property.

The civil suits that inevitably issue from blatantly unconstitutional citations like this are very expensive to settle. That Shiloh lady up there in Minnesota is in line for a second windfall when she and her lawyer are done raping that joke of a court, for example.

And SCOTUS has even slapped this shit back down in recent times; see Olivier v. City of Brandon, Mississippi (2026).

for a case like this to be successful you'd have to prove the landlord knew the man was dangerous. this is negligence. surprised they'd use just hiring the guy as proof of that

Not necessarily, hence my unlocked door door comment. One of the considerations the 10th has made was that the door was unlocked, and therefore the mexican did not have to use the master key to get in. If it had been locked, and he had used the master key, the landlord may have been liable because if not for the master key, the rape would not have happened.
