The only thing I can see being an issue is that Slatosch said a conclusionary statement that the contract was breached, which isn't kosher as far as I know of.
Even removing that section, the entire rest of it provides more than enough evidence for a trier of fact to come to that conclusion. So not an issue at all.
 
There was far too many "I don't think so," 's in this from Chupp. I doubt he was being ironic about it either, I legit believe he simply isn't aware about a lot of what he ruled off-the-cuff on.
 
I will admit, the retweet = conspiracy angle Ty went for on page 54 and 55 seemed kind of... limp. Dunno if it legally counts as prima facie, though.

I will criticize Ty for not arguing that the conspiracy he was targeting was the conspiracy to defame Vic after his release from Funimation.

Chupp was fixated that the conspiracy was to get Vic fired, which for Monica/Toye/Marchi could have been true, but for Funimation's conspiracy, it'd be much easier to argue that conspiracy charge was to conspiracy to defame and tortuously interfere with prospective contracts. Because that's the evidence Ty was attempting to present to the Judge, the 20+ emails after Vic got fired and Chupp wasn't having it because he was stuck on wanting evidence of a conspiracy to fire Vic, and wanting evidence from before he was fired.
 
Yeah this logic seems like "oh sure they committed a criminal act against you but you were able to bounce back from it so we won't punish the person who committed the criminal act against you".

I doubt this kind of logic would fly if applied to any other situation.
"I know I stabbed you multiple times, but you went to the hospital and you recovered just fine so it's like my stabbings never happened"
 
Chupp seemed... Confused most of the hearing.
Can any of the law kiwis pull up Chupps judicial history? Could this be a case of this being outside what he normally does? If he is not used to this section of civil law, that would explain a fair bit, especially because the sheer size of the filings could have prevented him from being able to bone up on the relevent law. Would explain an awful fucking lot from the bench, alongside what we can also deduce. .

He might just be a lazy fuck that doesn't want complex cases. Look at his docket: 85% is personal injury (he's a former personal injury lawyer before becoming judge), 10% contract/debt, and 4.8% civil, and 0.02% other.

Nah, not only does that help a little, that outright answers it. Between the sloppy filing from Beard, the mountain of bullshit from the defendants, and the fact that barely even 15% of his cases as a JUDGE cover the topic (And his lawyer experience is well outside of it). The Honorable Chupp is probably well and truly out of his depth, he and his clerks were robbed of the time needed to bone up on it, Beard failed to make a clear case that would help him grasp it intuitively, and he probably also just wants the bullshit to end.

Hell, there is a fairly good chance he has very rarely ever dealt with the TCPA. 95% of his stuff is well outside what the TCPA would be used for.
