Nah, he should have sued but with lawyers who specialize in these kinds of cases. Ty fucked up by thinking he could handle a kind of case he was not used to and then burried himself in blunders due to that inexperience. But there's no fucking way these rats weren't defaming him and messing with this livelihood. Fuck people who support phony metoo stuff. Tbh, that is not an error you would except of any licensed attorney, not cheap ones, and certainly not expensive ones.
Even attorneys who are retards normally have staff to make sure that deadlines don't get missed.
It was the fucking lynchpin of the case. All the sperging with depositions and tard-wars with West-Nile boy were irrelevant, they HAD to produce evidence, and they had it.
Their statement of facts would have needed to be taken as truth of the matter, as far as the TCPA was concerned. If they filed it properly, like any mouth breathing retard-lawyer would have been able to do, the appeals court would probably have overturned Chupp.
Chupp being a retard was not Ty's fault, but his I THOUGHT I COULD NOTARIZE OVER THE PHONE brainfart fucked the appeals, as far as I understand it.

This is what happens when you get a half-assed will writer (aka the first kind of lawyer to be replaced by GPT-3) to LARP as a litigator, at the recommendation of a balldo-sucking coomer with a room-temperature LSAT score and no real legal experience.
I bet Ty has notarized a lot of documents over the phone and never gotten caught for it before, but this was a TRIAL - someone's checking your work.
The Texas appeal was his last chance. To appeal to SCOTUS, you need someone with a supreme court bar admission to help you write and file the case. It's an exclusive club, and there's no way any of them are getting involved in a case with such glaringly awful legal work.

It's not that exclusive. You just need to be in good standing (no recent discipline) and have two recommendations from current members of the Supreme Court Bar. Then you can file a cert. petition and be shot down like everyone else.
A lot of people do it just to have what looks like an impressive credential on their wall even though unless you're an absolute fuckup, admission is barely more than a formality.
What's actually impressive? If you ever get to argue before it.
And as a practical matter if you want to appeal to SCOTUS your odds are so slim (in the vast majority of cases) that you wouldn't want a bumbling idiot handling it. You'd want someone who had actually done it before at least once.
