I know you're a stupid brain dead faggot, but I'm going to explain something for the benefit of everybody. If you want to say that there are circumstances where you can legally use self-defense against the police, they you would be
technically correct, the best kind of correct. Practically speaking, however, there is not going to be some happy ending where you heroically fight off the cops and then everyone applauds. This is Jack Reacher-esque fiction, a total power fantasy.
I'll tell you what are going to be the outcomes in the short and long term.
Lets assume that a cop says "You are under arrest."
1. You decide to comply with the officer's commands and are arrested and brought to the station.
Result 1: Unharmed and arrested.
2. You decide to fight the cops in 'self defense' which is going to end unwell. There are a lot of cops, they have backup and radios and helicopters and whatnot. You might be able to break free and flee but eventually you will be cornered and surrender, likely after getting your ass beat the fuck up
or the cops will kill you.
Result 2A: Arrested with minimal injury,
Result 2B: Arrested with major injury,
Result 3B: You're fucking dead.
Lets move on to the possible long term legal outcome part, where you've potentially decided to claim 'self defense'. Here's a newsflash - cops are
agents of the state and privileged to use force to carry out their lawful duties. LIKE ARRESTING PEOPLE. So if you're going to make an affirmative defense you have to start by proving that the underlying justification for your arrest was faulty
AND overcome the presumption of good faith courts give the officer, which is an extremely high bar. The courts have given a very wide latitude in regards to arrest and detention by officers (for reasons I'll explain below) and you are unlikely to overcome that.
Lets explore
Result 1, where you didn't resist and let the cops arrest you. We can imagine two scenarios:
Scenario 1: The officer arrested you because he has a reasonable belief you committed or are about to commit a crime, like assault or obstruction. Your attorney may be able to argue the officer lacked the probable cause required to support that arrest, and have the charges dismissed. If he is not able to do so, you still have hope - the charges might be low level and few (or one) so with a decent attorney you might get the DA to offer diversion or a plea for a lesser charge or probation.
Scenario 2: The officer arrested you due to some kind of objective error, for example the warrant was written for a different John Smith or whatever. In this case the charges will obviously be dismissed, and your attorney will likely be able to get everything cleared up. However, the courts are likely going to say the cop was acting in "good faith" with a warrant that was valid on its face, and so your recourse is limited. You might be able to wrangle a low figure settlement, if you're lucky.
The courts, and society in general, prefer these outcomes above. Nobody is injured or dead, everything is nice and orderly, and if a little goof up happens the impact is relatively minor. Sucks if it does, but no system is perfect, right? The alternative scenarios are going to result in cops, the suspect, or both ending up dead - maybe some bystanders too, depending on how the struggle and flight goes. Nobody wants a bunch of death and disorder fucking up their city and society.
Okay, lets go ahead and move to the scenarios where you actually fought the cops, like a dumbass, but did not die. You're going to be sitting in prison for a long time (you are going to be in custody until your trial my dude) while your family sells the car and house to pay for the attorneys trying to convince the judge that A) the underlying arrest was invalid and B) overcome the officer's belief that it was. Hopefully you have the officer in 4k video declaring he has no valid basis to arrest you but intends to do so anyway. Otherwise, good fucking luck, it probably won't work - and when it fails, you're going to be legally barred by the judge from presenting that defense at trial. Now even if you can convince a jury that you're innocent of the underlying crime the cop used to justify your arrest, you probably will have a tough time defending the charges of resisting arrest, fleeing, assaulting an officer, attempted murder, actual murder, etc. If by some miracle you do, congratulations, you get the live the rest of your life likely bankrupt from legal fees, suffering long-term effects of getting your ass beat severely and having lost years of your life in prison.
Now lets assume for a minute that the judge agrees the arrest was invalid and the cops knew that. Now you get to present the
affirmative defense of self defense, which means you have to justify every action you took as a reasonable and proportional response to an imminent force threat. I hope that on that 4k recording from above you have the cops admitting they intend to beat you senseless or execute you, because otherwise your attorney is going to have a hard time of it. I can hear it now; "My client knew Sergeant Snuffy's warrant was out of date and invalid so he was justified in whipping out the .45 and blasting him in the face. Otherwise he faced a deadly force threat of um...being arrested and put in a patrol car." It falls flat on reasonableness alone, because a reasonable person would believe (absent that 4k video above or something similar) that if he complies with the officer's commands and surrenders to the arrest he will not be physically harmed, as in our prior scenarios.
TOO LONG SHUT UP FAGGOT SUMMARY
The circumstances under which self defense applies to a police officer arresting you are so specific and so rare that I can think of only a handful, and those were only resolved after spending years and God-awful amounts of money. Fighting the cops is 99.9% of the time going to end badly - you're going to be dead or in prison and probably bankrupt as well. If a cop wants to arrest you, comply and have your attorney fight it later in court. Compliance will reduce* your risk of death or injury significantly.
*Cases like Daniel Shaver demonstrate you can't eliminate it completely.
