Allow me to quote my favorite self-defense textbook, Violence of Mind by Varg Freeborn (a guy who went to prison despite having an ironclad self-defense case):

Prison, is like dying, except you get to stay alive and watch what happens after you die, how everyone moves on without you, but you still get to hear all about it. It is truly a living death. Your friends will move on and forget you. Your spouse might hang in there for a while but eventually they will move on, too. You may not know the details either, you may have to just wonder. Did she meet someone else? When did it start? Was she already thinking about leaving before this? No one owes you any answers, and you will have all the time in the world to wonder about it all. It will drive you crazy.

Everyone will move on with their lives just like you were laid in the ground. You'll live out your days in captivity with predators much meaner than you, while your spouse lays down with someone else and your kids get their school clothes from some other guy. Or maybe they don’t get any school clothes. Hell, maybe they get beat and you do hear about it. But you can’t do shit about it. Nothing. You are powerless to protect them, and they know it, too. All the anger and determination in the world won’t help you save them. This isn’t hypothetical, and I’m not making this up. This is shit I watched men go through on just about a daily basis.

The "I'd rather be judged..." phrase also denotes a complete lack of thought concerning how to prepare for an event. What does it mean? It sounds a lot like it means, “I'm not going to worry about the aftermath, nor am I going to put much thought into the subject, I'm killing them and screw the consequences.” It’s pure laziness and arrogance. It’s a losing attitude. If your mission is to make it home with your family every night for the rest of your life, then you are openly stating that you are willing to just fail as long as you get to kill the other guy. Yes, it is possible that you may die or go to prison as a result of a fight. But rather than focusing on the possible loss, isn’t it more advisable to focus on and train hard for the win?

While the spirit of courageous self-defense is commendable, like it or not, there are more ways to lose than by taking physical damage. Your entire life can be ruined, and you'll wish you had died. This isn't about cowering; it's about making sure you have at least thought about how to do things correctly to have the best possible chance to maintain your legal shroud of self-defense.

If you are an instructor and teaching students this phrase, just stop it. You are fucked up. It's arrogant, misinformed, lazy and a complete violation of the trust given to you as an instructor. If you are a student and someone says that in a class, run away from that as quickly as possible. Some people, or dare I say most people, are completely clueless as to how the legal system truly functions.

Some believe it will just be clear cut that they are the "good guy" and won't be charged, or that the NRA will step in and save you (as if they really take a personal interest in every single civilian in self-defense case across the country). CCW Insurance may or may not help, but it is not a savior and cannot change how the legal system operates. That insurance will not change the fact that 95% of charges end in plea bargain convictions. Once a prosecutor gets you in the crosshairs, you better have ample supplies of cash and you better have crossed all of your t's and dotted all of your i's before, during and after the deadly fight you are now charged for. Right or wrong, win or lose, it's going to be a long, expensive ride.

And remember, insurance or not, the conviction rate is 95%.
