It is implied that he was hired by Hank's family in order to speed up the process.

Also, what difference could a criminal defense lawyer have made? Criminal defense comes in three forms: "My client didn't do it", "My client was justified in doing it" and "My client is remorseful and regretted doing it". Every defense is a variation of those three.

Let me give an example for each: "My client has a tight alibi", "My client was defending himself against an attacker" and "My client was never the same after the accident and has not touched a bottle since".

None of these defenses would work for Smally: He filmed himself committing the crimes so there is no doubt of his guilt, there is no scenario short of a gun on the head to justify these actions and he has faked remorse countless times. No lawyer can save his ass even in the best case scenario. He is at the mercy of the judge now.

I know next to nothing about the Korean legal system. But in the US having the right representation can at the very least minimize consequences for the same charges. They’re often better prepared, and experts at raising reasonable doubt. Not to mention better connected. Not like either of them can afford someone like that, though.

I’m glad he has the tax guy, he’s probably doing more damage than a public defender based on what we heard.

My point is that it does not matter whether it is a criminal defense lawyer or a tax guy. There is no defense that would help Smally. In the words of Ted from Scrubs (RIP): Oh come on! A good lawyer couldn't have won this! It does not matter what defense any lawyer prepared, Smally has done something that invalidated it.

Do not take this the wrong way but how closely do you follow Smally? This is not the fault of the tax lawyer. He does not deserve blame. Smally did EVERYTHING he could to maximize the consequences of his actions. He insulted the judge, he threatened his family, he threatened and harassed the victims to get them to drop the charges, he committed more crimes every time he acted remorsefully and was acting like an idiot in court. How could a lawyer help him when he has acted like that?

I'm pretty astounded even a Lionel Hutz level attorney would try the "he was drunk" defense. Because it isn't one. I mean maybe I'm ignorant of some quirk of Korean law but that's pretty much not a defense anywhere.

He’s not getting acquitted of anything, And I know everything about Ramsey dude. I know his parent’s address. Why do you think it’s about “beating the case” exactly? This isn’t TV. He’s not going to. He’s getting convicted of numerous crimes, thankfully.
Better legal representation will typically reduce your punishment. This tax guy is only adding fuel to the fire, which I personally enjoy and have no complaints about. It makes his time longer.
I’m only speaking from a legal perspective, and pointing out that he has the wrong attorney for the job because of Hanks grandpa. Of course Hank can’t pay for the fucking Johnny Cochran of Soeul. Lol

Key word being "typically". My argument is that no matter what ANY lawyer tries to reduce the punishment, it will fail. The judge is out for blood due to Smally's actions. No defense will be effective.

Alright, in your opinion, what could the defense say that could work to lessen the punishment?

The Lotte world incident already had a petition for severe punishment filed with the court(still don't know if that was accepted yet and probably won't be known until sentencing). Instead of at a minimum keeping his mouth shut and trying to stay out of the public eye, he's been chimping out off and on over the past 10 months or so doing the exact opposite of what anyone with a brain looking for any kind of leniency on sentencing would do. I'm not sure what sort of legal representation you think exists that could do anything about that short of having tied him up in a basement somewhere once the first charges were filed and we're obviously long past that point.

Maybe an argument could be made that the government not locking him up enabled his stupid alcoholic ass to continue being a retard, which seems to have been the point but that still doesn't change that he still chose to walk right into that of his own free will.

"Ok, and he still put it around his neck, threw the other end over a tree, and proceeded to hang himself with it"
That's not exactly going to accomplish much.

Keep it up, Jungkook or whatever the judge's name is. Complete life ruination probably won't teach Johnny Somali / Ramsey Khalid Ismael anything but you can sure as shit try. I wish this would stop freaks from coming to your country, accosting your citizens and disrespecting your culture but it likely will not. Please throw him in the cabbage mines for the remainder of his natural life anyways, if not for rehabilitation, then just because it would be really, really funny.
