Via cellular towers and uniquely identifable SIM cards. If you registered your SIM card with your identity (which is retarded and only some MSPs enforce it due to laws preventing anonymous SIM cards, then again you can find some SIM cards reigstered to some bogus identity at your local black market), then your MSP can basically track where you are, because your phone communicates with it without a warning
Basically just don't put a SIM card and rip off the modem of your phone
 
I went to check up on this because the phones were supposed to be "shipped in August". I have not been able to find anyone who has actually received a device yet, HOWEVER I did stumble upon a huge rabbit hole regarding Erik's latest tweet:

So what is "Clear"? Apparently it's this company: clearfoundation.co.nz (Archive)
The ClearFoundation is a New Zealand company which was created in 2009 with the purpose of developing and maintaining ClearOS under a Simple, Secure, and Affordable open source model.

On the new version of the website freedomphone.com (Archive), the devices no longer advertise FreedomOS and "Trust", instead ClearOS and ClearGM have taken their place. What the ramifications are for devices that have "already shipped" is unknown and unexplained.

Also noticeable on the new site is "powered by Clear" texts and logos throughout. The back of the devices in sample photos now show a larger Clear logo above the Freedom Phone logo. And even the name of the device is changed to FreedomPHONE to match the Clear branding style.

ClearUnited

More digging on the new site led me to a footer link labelled "Private Membership". It leads to some sort of agreement page with no actions (like a terms of service page) labelled "ClearCompanies Private Membership Association"

In general, members of a private membership association do not fall under the jurisdiction of local, state, and federal governments and corresponding laws and regulations.
What could come under scrutiny and in some cases be considered a criminal act outside the association can be perfectly legal within the protection of a private association.

My first thought reading this was "what is a private membership association" so I searched that exact phrase and the number 1 result was nature-cures.org. Not having high hopes, I clicked it and what do you know, its the exact same fucking text as the "What is the History of a Private Membership Association" section of the document.

Don't worry, if you change your mind, early cancellation is available after 4 months, and the "fee is just two months payment." We also get included ClearUnited membership, ClearCELL service, and built in features like ClearOS and ClearGM. Those sound familiar so let's check out the ClearPHONE 220.

Surprise, it has the exact same specs as the Freedom Phone: 6.088in display, 1560x720 res, 4000mAH battery, 1.8Ghz processor, and so on. I guess that raises the question: which came first? ClearPHONE or Freedom Phone? The answer is ClearPHONE, they did a Kickstarter way back in 2019.

They even managed to raise >$35,000. There is also an old listing (Dec 2020 Archive) of the 2019 ClearPHONE on the ClearUnited website. The specs on this device are different from the current Freedom Phone / ClearPHONE 220 and seems to line up more with the ClearPHONE 420. My guess is that Clear decided to buy rights to the Freedom Phone to have their own budget model offer ClearPHONE. This is also partially based on the fact that the new, pre-order ClearPHONEs only come in 4,6,8xx variants, no 2xx.

ClearOS

ClearOS Mobile supposedly connects all Clear services, provides total app freedom, and protects your data; all the while being a super secure OS. The problem is, that's ALL we know about it. It's supposedly open source, as stated in the Kickstarter and product pages.

This is the same exact CHANGELOG table as https://download.lineageos.org/. The commit messages even link back to the LineageOS site. Unfortunately the archive does not preserve HTML comments, but if we look, it seems like they did literally copy paste from the LineageOS downloads site and comment out references to LineageOS.

In conclusion

I think Erik Finman has partnered with a sleazy company to turn a $500 shitty phone grift into a $50/month shitty phone subscription grift. The depths of this partnership/buyout/takeover are still unknown, along with any details at all about: the device, ClearOS, the "security apps/features," how future updates will be handled, and so on.

Hopefully someone actually gets their hands on a device to reveal all soon. This poor churnalist got their order cancelled (Archive) and had to place another, probably incognito. But when people do finally get them, its a good thing that Freedom Phone has an amazing return policy. Wonder where they got it from?

I'm no security expert, but that sounds like the last thing I'd use if I wanted privacy or security.
 
It's probably already successful. You can brand anything with "Patriot", "Freedom," "America First" and the like and charge about a 200%+ mark up compared to normal retail shit, then sell it to boomers and conservative consoomers. Black Rifle Coffee and the 'tactical fashion' industry also come to mind for this sort of marketing scam.
Don't forget all those self-proclaimed ancaps and other overly libertarian subcultures. Surprised that it didn't market to Hungary or Switzerland, or maybe even Russia if they're that naive. The Daily Wire even markets itself to Hungary.
 
Could be another Malibal or Chris-Chan business saga kind of situation, where deliveries are retardedly late and in the most ballsy form of packaging or conditions.
