Would Barb have been taken into custody for investigation and had a protective order given if she WAS completely lucid? (the answer is no, people are just trying to cope. Barb would not willingly leave the house.)

Chris raped his mentally disabled mom.
 
I've seen a documentary or two where dementia patients forget who their kids are and end up "coming on" to them. Nobody knows Barbs true condition but from the images I've seen of her she looks gone. But when people are that far along with dementia...I doubt Chris has the capacity to care for someone that bad. As in, keep alive. Not just...not have sex with.

From the supposed chat transcript he was definitely pushing it further and further until he got what he wanted.

But. He didn't know it was rape. He wasn't concealing her identity because he thought he was guilty of rape. He was concealing it because its his mother. And he at least has enough wherewithal to know people don't fuck their own mothers.

I think even if he knows it's rape, he wouldn't give a shit. He would excuse it as "Barb being into it, so he decided to do it".

Normal cognitive decline coinciding with age is not the same as dementia, which is a medically diagnosable condition. From what we know, the class was designed as a general overview for caring for aging individuals, not one specifically taught for the purpose of caring for dementia patients. I'll also state once again that neither of these (general cognitive decline nor diagnosed dementia) automatically make an individual incompetent in the eyes of the law.

I'm not defending Chris, I think he definitely raped her, I'm just trying to point out that we haven't definitively concluded anything at this point, and legal definitions are often different than what we perceive as fact. I also believe the fact that he wasn't taken into custody on the afternoon/evening of the 30th means there likely wasn't enough evidence to charge him with any crime, and it's going to be increasingly difficult to find that evidence as more time passes.

Considering he knew well enough to try and keep it hidden until a totally real girl asked him, I'd say yes. But truly, we'll probably never know and you know what? I don't want to know, I really don't care, he had sex with his mom. That's enough to know and I'm not happy I know that.
