And as far as I know, the judge said "if you do this it's a mistrial." [prosecution does it] "So a mistrial then?" "lolno."

I don't know if this is a final lolno, or if the Judge could come back this afternoon or tomorrow and say "actually fuckit, the Prosecution is bullshit and gay and this is over." I also don't know if the Defense can appeal and force a mistrial on appeal over this?
 
Just saw a news report on channel 4. Still biased and even speaking the implied threats of BLM on air. Shame I live in a bubble where everyone knows flyd dindu nuffin and will justify the destruction of entire towns with “that’s how changes are made”.

I assume an appeal target gets painted by this, right? Don't know anything about law, but seems like a huge flaw if a guilty verdict gets reached.
 
I will SNEED so hard if this case gets mistrialed due to the prosecution being gay. Imagine how the media will be forced to acknowledge that their narrative was wrong.
They will never admit that they were wrong. The narrative will be that racist murdercop Derek Michael Chauvin got away with murder due to a technicality endemic to a corrupt justice system.

Tobin said something about an arterial blood draw that they did while Floyd was at “Hennefim County” which I assume is the Hennepin hospital. It isn’t obvious to me how that would be relevant to CO intake before the resuscitation efforts, though?
All the papers I’ve found that discuss asphyxia and artial blood O2 concentration are behind subscriptions. *sigh*
arterial blood gas testing is extremely accurate and throws a wrench into the asphyxia narrative. I doubt that anyone who died of being unable to breath would recover to that extent, even with resuscitation efforts. It is almost always a lost cause to resuscitate someone who was without oxygen for several minutes, but of course there is a duty to try. If you can stabilize someone who was forcibly deprived of oxygen you generally end up with a brain dead or brain damaged patient and await the decision of the family or an advanced directive. but that didn't happen. He died anyway. He died despite the O2 levels being normalized, either organically or through intervention. That says something else was wrong.

I am starting to agree most with the expert that testified that so many conditions occurring at once makes it impossible to pinpoint a cause of death, some of the theories can be excluded but not everything. The drugs and pre-existing medical conditions make it too difficult to differentiate between remaining possible causes. The tumor floyd had secretes hormones associated with fight or flight reflexes, it may explain his habit of extreme nervousness, but it also complicates things even further since those hormones are damaging to the cardiovascular system when there is an excess of it long-term.
 
All I can say is a Prosecution Fuckup Mistrial causing Chauvin to walk would be the absolute best ending to this. It would cockblock both sides forever, and we'd immediately hit Chimpout Stage 3 if not 4 across the entire US.

So what is this Prosecution fuck up that could lead to a Mistrial?

Prosecutor hid evidence from the defense. (Floyd's blood was 98% O2, which means he couldn't have been affected by Carbon Monoxide Poisoning, but also highly suggests he didn't choke to death.)

Defense fucked over one of their witnesses with a curveball (Carbon Monoxide), so suddenly they wanted to bring it up.

Judge said they couldn't, and if they did it would be a Mistrial.

5 minutes later, they did it anyway via the Potato Nigger "Expert" that suggested eating Cigarettes is a good thing for your health and a 90% clogged artery is just fucking DANDY for your heart.

I just can't understand why the prosecution would bring this up if it torpedoes the asphyxia narrative, which was their strongest case. So, I assume they know something that isn't obvious to us. Without the asphyxia narrative, all they have left is, "well, maybe he did die of a drug overdose, but you should have been doing CPR," which would throw out both murder charges.

Imagine the carnage if Udgey called a mistrial right then and there. That fortified courthouse would IMMEDIATELY be under siege.
Maybe that's why the direct and cross were so truncated? They all know it's over, but they can at least save their own skins.
 
I'm a total layperson when it comes to trials, after closing next week how long do juries deliberate for? Do they have an indefinite amount of time or is there a deadline?
they deliberate until they agree on a verdict, or until they agree that they can't agree on a verdict, in which case the judge declares a mistrial and a new, separate trial is held with a new, separate jury.
 
There's not going to bea fucking mistrial. You don't walk when the state wants your blood as badly as they want Chauvin's.

It certainly seems that way, especially since the Judge specifically said so.

But it appears that the Judge refused, since he's sent everyone home for closing arguments on Monday. This was after meeting in chambers during/after that weird double break.

If there is a mistrial, then that just means we have to do this all over again, right? Would Nelson want to subject himself to that torment, or would it be a good idea because he would get a chance for a do-over while knowing exactly what tricks the prosecution will pull?

Nelson must feel like he's seeded the jury with reasonable doubt, and my thinking on this is due to the fact that he only called witnesses for what, two days? IIRC there were a bunch of people on Tuesday including the use-of-force expert and then Based Rhodesian was the only witness yesterday. I am surprised that he didn't call a midget cardiologist of his own, but maybe he felt like deep dicking the prosecution's guy on the cross was enough. And Nelson's power move was always going to be shitting up the prosecution's case and getting them to look like clowns playing whack-a-mole with shit like whether Squad 320 was running or not.

There are a lot of questions that I guess we will never get answers to. Did we ever get anyone to say whether Floyd pissed himself or not? Did anyone ever testify about whether Floyd busted his lip in the back of the car? What happened with the week-long hospital stay? But I guess if there's a mistrial or the case goes to appeal then Nelson's got some dry powder for that. Or maybe it's a 4D chess move where the jury is going to be sitting there thinking about all the loose strings (really, was that squad car running or not???) and they're going to pin the blame for a lot of that shit on the prosecution.

My overall impression is that Nelson came off as polite to the witnesses (even when they were beclowning themselves), tried to keep his questions straightforward and to the point, and didn't waste everyone's time. I think most importantly, he didn't try to come off like he was smarter (i.e. "better") than anyone on the stand. Yeah, he could drag it out for another week, but that might be counterproductive.

The prosecution, meanwhile, started off strong but spent a lot of their time for the last week and a half making appeals to emotion, using rhetorical tricks, objecting for the sake of objecting, being generally hostile to the witnesses, and going down bunny trails. For example, during yesterday's questioning of Based Rhodesian, the prosecution asked him if he was a pulmonologist and when he said no they asked him how much time he'd spent prior to the trial measuring potential lung volume of an airborne swallow carrying a coconut and all that shit and it's like.... why didn't you ask Felonious all that shit too 'cause you'd get the same answer. It was an attempt to make Based Rhodesian look stupid but it came off as gratuitous.

Chuck Rosenberg on MSNBC has said consistently throughout the trial that the prosecution needs to build their case brick-by-brick, so using the witnesses who were at the scene to introduce evidence worked very well for the prosecution at the outset. The foundation they created was pretty sturdy. They made the assembled crowd seem like a group of well-intentioned citizens who were justifiably upset at what appeared from their limited perspective to be a clear-cut case of police brutality. But then the prosecution got cocky, threw out the blueprints, and are now left with a structure three walls short of a brick shithouse.

Nelson, meanwhile, spent a quarter of the time digging a hole in the ground that's a perfectly good long-drop-cum-tiger-trap.
