Free State Foundation's Seth Cooper, in a blog post late Thursday (Dec. 17) pointed out that the bipartisan Protecting Lawful Streaming Act, which would up those penalties, was at press time still attached to an omnibus spending bill that needs to pass to prevent a government shutdown. That is not to be confused with the COVID-19 aid bill also being worked on, or the Defense authorization bill that just passed but the President has threatened to veto.


Studios, independent producers, and unions have pushed for at least a decade to get Congress to make stealing video streams a felony, as it is for illegally copying and distributing copyrighted TV shows and movies. But that was before must-see TV had morphed into "must stream video," as FCC chairman Ajit Pai put it earlier this week.

Currently, a pirated stream is treated as an illegal performance, which is a misdemeanor, rather than illegal reproduction and distribution, which is a felony. Making it a felony would mean larger penalties, potential prison time, both of which would be a greater deterrent.


Sen. Thom Tillis (R-N.C.), who introduced the new bill last week, says it is targeted to large-scale, criminal, for profit, streaming services, not good faith business disputes or noncommercial activities. It does not target individuals who access the pirated streams or unwittingly stream unauthorized copies of copyrighted works.

“The shift toward streaming content online has resulted in criminal streaming services illegally distributing copyrighted material that costs the U.S. economy nearly $30 billion every year, and discourages the production of creative content that Americans enjoy,” said Sen. Tillis of his bill. “This commonsense legislation was drafted with the input of creators, user groups, and technology companies and is narrowly targeted so that only criminal organizations are punished and that no individual streamer has to worry about the fear of prosecution."

He pointed out that fair use fans like Public Knowledge are neutral on the bill.

Co-sponsors of the legislation include Sens. Patrick Leahy (D-Vt.), Marsha Blackburn (R-Tenn.), Mazie Hirono (D-Hawaii), Catherine Cortez Masto (D-Nev.), John Cornyn (R-Texas), Richard Blumenthal (D-Conn.), Chris Coons (D-Del.), Kelly Loeffler (R-Ga.), and David Perdue (R-Ga.).

The Obama Administration asked Congress to "clarify" that streaming illegal content, as well as downloading it, was a felony, an effort pushed by then White House Intellectual Property Enforcement coordinator Victoria Espinel. Among the senators supporting that bipartisan legislative effort were Leahy, Coons, and Cornyn.


"Budgetary issues aside, the Protecting Lawful Streaming Act is strong on its own merits," said Cooper in his blog post. "In whatever legislative vehicle proves most practical, Congress should pass the bill and the President should sign it."

These companies are making more than ever and people are less wealthy than ever. Punishing the poor for being poor is wrong, particularly when the rich still make insane amounts regardless of pirating.

The fact that when Youtube allowed old shows to be uploaded and successfully overruled Viacom for them to get fucked up the ass with barbed dildos, they should had gone with the reaming. I think if that happened, Viacom would be kicked in the dick hard enough to make actual entertaining shit again on TV like before 2001: An American Guilt Trip Odyssey and influence Hollowood and other producers to quit filling it up with Baby June and sensationalist garbage for stupid people and corn syrup additive mutant autists.

It is amazing what quality does in the long run for the human condition. But since this is reality, I can't wait what 2020 has in store for the world, let alone the US.
 
Makemkv is like a one time fee of $50 and you can copy all the movies you want. When I had Netflix dvd subscription, it was like a rotating pirating machine. Get DVD, rip, send back, get next DVD repeat.

KissAnime was always on a lifeline and it's not surprising that they ran out of places to run. There are still lots of places to stream and the whole point is that they fold and then reappear under a new name later.

Yall torrenting is still viable. VPNs provide some protection. Otherwise just rip the discs.
 
I see the Verizon Lawyer is trying to push the oft-disproven argument of “piracy costs the economy billions” as if every single person pirating something was ever going to pay for it in the first place, and also as if that money just vanished in to thin air instead of being spent elsewhere. People who pirate things very rarely are going to spend that money on the things they pirate either way. The entire entertainment industry probably loses maybe a couple million a year off people that would have bought a copy but decided to pirate instead, and that’s still being generous, and that money still goes in to the economy.
 
Since this is currently just a bill trying to get passed by yet another dimwit GOP critter who doesn't really understand how the internet can and does work, I'll reserve my concern until it appears to have a chance of being passed into law. But even then, this bill doesn't really change a whole lot, from what I can see, other than twisting around what fair use is defined as. This is so easy to circumvent with a little tech know how that it's essentially pointless moral grandstanding for pedowood points or some shit.

Getting around this is so simple that it just seems like more congressional hot air. Why do we elect (and pay, for some reason) these waterheads again?
1) Buy a decent android tv box and root it, then lock out all of google's spy bs
2) Get a decent VPN with the money you would pay for one of Disney+\Nutflick\HBOMO\etc
3) Toss plex and Kodi on it, then set up a decent Kodi build with an easy to find and install wizard and set up plex if that's your bag. And a torrent client. Mobdro too, if that's still a thing
4) (Optional) chuck popcorn time, Tubi, Plutotv and any other free streaming app on there your little heart desires
5) Get beer and popcorn and melt your brain with the garbage that passes for TV and movies these days or watch whatever you want from the past.
In a few hours, you too can become a living embodiment of the old robot chicken TIVO sketch, if you so desire.

You don't need to do any of that, because this Bill isn't about the end user.
This Bill is about changing the penalty for the person who streams it out, making sending a stream out the same as seeding.
 
Since this law would technically apply to seeding, have a refresher on Piracy 101: Just make sure you’re using a VPN that supports P2P based in a country with strict data laws and that doesn’t log anything when you torrent or seed, like everybody should be doing period. ISPs don’t give a rats ass about what you do until they start getting complaints about it, and the only way your ISP will get a complaint is if you’re retarded and use popular torrents with an unmasked address, which will get picked up by snooping companies paid by corporations to log the IPs connected to a torrent and send out DMCA complaints to the ISPs associated with those IPs, who will then trace your IP to your account via an automated process and send you a nasty email.

Even using a basic VPN is enough to deter most shit, but if you’re constantly torrenting and seeding and the company in question really hates it, they may try to subpoena your VPN for your info, which won’t happen often if they’re not based on your home country, and if it does and your VPN doesnt log anything anyway, you’re safe. The only issue becomes when the VPN connection drops or leaks, so find one that also has a kill switch feature to shut off your network streams if the connection to VPN is lost or disrupted in anyway.

All that said, unless you’re hosting a streaming website for the masses or are running a bunch of seed boxes to send out the latest and most popular movies and TV shows, you’re not big enough for anybody to bother going after, and all the above is just precautionary. This is essentially a flex bill by billion dollar corporations trying to look scary and tough with the hopes it will frighten off any would-be pirates, but they’re all decrepit old faggots or former lobbyist lawyers that have no idea how the internet actually works, so even basic steps everybody should be doing anyway will screw them over just like they always do.
 
Official streaming services deserve the rope. Imagine paying for such low quality of service. Having some mexican fuck ring your doorbell, jack off into some bootleg dvd case and handing it to you would be better quality of service.
