Legal question to the afficionados: Do we get informed if there's sur-replies we should be waiting for, or a date dropping for the oral arguments? I genuinely don't know how the next step is gonna present itself. I'm guessing Ty needs to check the timeframe the court has for oral arguments and organise with defense counsel a date where they can all be present in front of the panel for 'em, or is it the panel itself that appoint a date?

There's no actual specific deadline for sur-replies beyond those specifically authorized by the rules, and the appeals panel has been applying the accelerated schedule since the beginning, despite the parties kicking and screaming and not filing a single brief without delays. So if they want to engage in motion practice it should probably be soon. Then there's also the issue of whether any non-conformities like word count still exist and, if they do, whether they'll be challenged either by the panel itself or by the adverse parties.

If there's anything there, I can't see Wick Phillips passing up the chance for some motion practice. If that happens, it could delay the outcome some more. If Vic actually has exceeded word count the relief could be anything from striking some arbitrary part of the excess to the entire set of filings, at the extreme end, to giving them an opportunity to amend, to just giving the other side more words to counter.

I have no idea whether there is some exception that allows them to file in excess of 27,000 words.

The very last document filed would probably be a sur-reply on the attorney fees issue if Vic's team feels like it (and somehow hasn't used up all their words considering they seem to have exceeded their allotment).

Nothing is ever 100% in court, but the fees issue is probably about as close as it gets. Damn good filing. The best one from Ty so far by a long shot. Lemonfuhrer got totally BTFO imo. Wick Phillips is chasing their tail if they keep wasting more money on bs fees motions.

Having watched the streams, I agree. The replies to Moronica’s brief and especially the fees appeal were excellent, and easily the best replies they did here. They were solid, on the mark and had very little typing errors. I don’t think it’s a coincidence that these were the most polished of the bunch. Out of the four defendants, these two were the ones that did the most damage and these two replies had to be good. Thankfully, they were.

So overall, the Moronica replies were the best, the Funimation one was generally good marred by weak grammar and misspelling and the Marchi one was easily the weakest and most sloppy of the four, redeemed only by its vicious tone and effective arguments regarding defamation.

I agree. These files maybe messy ( especially marchi's) but they get the point across loud and clear. It honestly shows that mike Dummford and the rest of of law twitter didnt actually read the filings and only made fun of the errors. They wont even admit that lemonie's filings in this whole case is the actual dumpster fire

Lemoine could present the shriveled up West Nile lung and they'd write 20 pages worth of praise on some platform like Medium or the one newspaper that Griftsby works for
 
So far the lesson from this case has been "everything > case law".
They'll glorify Phlegmoine's butchering of the English text and senseless money spending and vilify Ty and Martinez's documents for admitted spelling errors and sloppy grammar (which are nevertheless common in law expertise), because fuck common sense! To hell with the truth! They need to keep their narrative alive at all costs!

As stylistically fucked up as Ty's filings have been at times, Lemoine's are at least equally as bad and the arguments are worse. If I'd give Ty's filings in the appeal a C-, Lemoine's are hovering between D and F and are easily the worst in the entire case, from the trial court to now. Erick's are second worst.

Tbf, based on the way Mr. Toye's been talking in his recent interviews been talking in his recent interviews, he seems to believe he knows the most about the case law out of anyone. Maybe he should just fire his council and represent himself
