Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

I have a confession to make.

Ty Beard hired me to proofread things. Because I'm a Marine and he assumed I am: 1.) an alcoholic and; 2.) retarded, he gave me a six-pack of Guinness as payment and told me to mark all the errors in crayons, also provided.

Obviously as a Marine I ate the crayons and told him there were noerrors. I got food and alcohol for nothing. I win in this deal.

I WAS KICKVIC ALL ALONG!

You all always get so salty over little things in the documents.

Of course. Lawyers are the only people that could produce dog shit like this and collect bank. People that get paid less are not afforded such kindness. All sides have done this and it is annoying.

It would not take long to fix either and they all get extensions.

You even ate the green crayons?

It would not take long to fix either and when you consider they got an extension they have no excuse.

They got two extenstions, even. It's not likely to affect the overall arguments in the slightest but yes, with the amount of money that's being doled out you'd think there'd be some better proofreading.

a fuckn intern would have found those errors...

A professional office of any kind has a lady reading and formating everything.

Their office might not even exist at the moment thanks to COVID. At least that's the excuse I'd give if I handed in this stuff and the appeals court kicked it back.

As I've said before, the sloppy formatting/grammer/etc is anywhere from distracting to annoying. Luckily, the actual substance is solid (relative to the particular causes of action against each particular defendant; to this day I still think tortious interference for Marchi is easily beatable for her). The cross-appeal reply pretty much puts the nail in the coffin that MoRon get anything more than their $100k.

As long as the appeals panel doesn't go anal retentive and lights the sloppy replies on fire, it probably won't mean anything. It's just... annoys me on a professional level. I do electronic repairs, and if I find I've missed a screw (even an unimportant screw that no one will miss and won't impact the machine's performance) I disassemble the thing to replace it because I take pride in my work.

I'm just projecting that onto Ty, I guess.

I WAS KICKVIC ALL ALONG!
No, it just means you're a jarhead.

Goddamn. I will offer my formatting and styling services to Ty for fucking free if it will JUST STOP THE GODDAMN EYESORES FROM HAPPENING!!! It hurts my soul ffs. After 10 years of working on technical documents I have it down to a science.

I'll do it for Lemons as well because this is an affront to God and nature that must be corrected for the good of humanity.

Última edición:
i still feel like people are blowing it out of proportion here

Incompetence is understandable, apathy is annoying. They didn't finish the work that the public was asked to pay for.

You keep saying they could go autisticly comb over their documents before release for every little error, but every minute of that would be billed to Vic, and he's raised less than 300k for a year's worth of lawyering. It's entirely possible that Vic himself has said 'no, it's fine, just make sure it's competently worded, because I'm not made of infinite money'.

Ty said that Carey Christie (Amazon Prime) watched every single minute of Nick's show breaking down the various filings in the appeal. I hope they didn't charge the GoFundMe for that.

Who fucking knows. But if this can be a catalyst for the Texas Legislature to reform/Fix TCPA then it's worth it to me. I never even donated to this thing, I just watched the car wreck.

I just hope hope hope MoRons sue Nick somewhere for something, because that will be hilarious

I'm pretty sure Ty has also said that they haven't, and wouldn't, bill Vic (or the GoFundMe) for any time they spend watching YouTube videos (or appearing in them, or going to conventions).

Ty should just release the docs on the farm a day before the deadline and get free proofreading. Or you know start being a professional.

The early memes of fear the beard were funny but as this progressed, it mostly transformed to "laugh at the beard".

To add to this, Ty has always been strict with to not speak ill of opposing council during the case, and on the last stream he started ranting about it, even though it was Lemoine, which made me have to reevaluate, bought in to the hype at first, then filing after filing, he started to not look that impressive, and now he went back on his own rules.

And what do one say? Actions speaks louder than words.

You all always get so salty over little things in the documents. The arguments were made competently, and that's really what's important assuming no fatal defects like what happened (and was immediately corrected) in the Funi document. It's entirely possible that Vic himself has said 'no, it's fine, just make sure it's competently worded, because I'm not made of infinite money'. None of the things you fuss over have meant anything so far other than the 2AP thing, which has been discussed to death about whether Chupp was wrong to disregard it and whether Chupp would just have ignored everything in it and thrown the whole case out anyway because he didn't want to deal with it.

Frankly, I just look forward to some oral arguments and responses by the appeal courts, because we've had like six months now of Vic and the defendants essentially just having a loud social media fight in legalese with nobody whose opinion actually matters saying anything about it. Honestly, even the TCPA hearing barely qualifies, because Chupp didn't even go through the evidence and arguments to decide who was right, he just yeeted the whole thing off his desk as quickly as possible, didn't really listen to either side's arguments, and wrote up a quick 'whatever it was the defendants said is what I agree with I guess, get this off my docket' judgment.
Imagine paying hundreds of dollars an hour to a legal team and they best they can do it fuck up the format and keep missing important parts of procedure.

No matter how long they have between documents they always seem to be rushed, how can a collection of overpaid plebs all be so bad at proof reading?

I don't care how well they've done in other cases, how much money they've made, how they've got bigger clients that pay more money or whatever.

It's exceptional for them to continue to operate like this. Even if Vic isn't their highest paying client he's definitely the one putting them in the spotlight. More people will be scrutinizing every inch of those documents. The least they could do is proofread.

With how much time they had for this, I would expect the bulk of mistakes to be misusing commas or fucking up capitalization.
Not pluralizing words that shouldn't be.
Not leaving in fucking notes to themselves (A or B - need to pick one).
Not failing to abide by such simple rules of formatting for the court as using italics.
For fucks sake, it really seems like no one just sat down and did one full read through the document. I just don't get it.

The problem is that they didn't have someone go through with truly fresh eyes. That's the way to pick up on these things. Have a style checklist. Have a formatting nerd (like me) who lives for correcting this shit. Let them be the last set of eyes. It really really helps.

And most importantly : DON'T DO IT ON A COMPUTER. Print it out old school style and take a damn blue pen to it. Then hand it back with all the marks to the original writers for their thumbs up. Then go through and change the computer file.

Works like a charm every damn time.
