Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

Talking about settlements, yes I know way to early considering appeals court will still take a few months to do anything, but it's an interesting point.
What could Funimation offer for a settlement? Sabat is still somewhat important because of the studio thing and he is very anti Vic, also they can't offer to give him back his roles and use Vic in any future endeavors because that is unsustainable because those are not their Property, Funimation only gets the licence for the dubbing and that can change at the drop of a hat.
Money is also not that good of an option because it would have to be a huge amount and also might affect Vic negatively if he took money instead of continuing with the lawsuit, the idiots would certainly try and spin it as him knowing he couldn't win and settling instead, so that is also not that good of an idea.
It could be a letter that essentially said "Vic did nothing wrong, it's just that these bitches are bitter and crazy, specially Ron, and they made up a series of rumors and stories due to their jealousy." But that is also not very likely because the optics would be bad for Funi...

So what could they offer for a settlement?

So what could they offer for a settlement?

A bunch of money and just publicly say what they're claiming to the court already. They claim they never said they fired Vic because of harassment or because of the "investigation." Just say they never said that, apologize for giving that FALSE impression which is COMPLETELY NOT TRUE, and pay a lot of money.

The heads of the other defendants, and Sabat, on a silver platter: Any HR documents. Any emails that went through the Funimation system. Any internal communications. Any internal Slack communications. Private recordings they might have.

A public apology. A public clarification. Forcing Sabat to use Vic's recordings provided from another recording studio, possibly from Vic's home studio, or a studio that Funimation is no doubt being forced to set up soon via Sony. (If they are not setting one up after Funileaks, then they're being replaced by Aniplex soon.)

Money. Guaranteed roles. His job he was about to get as Voice Director back, which would make him the bosses of the defendants and the not-defendants (SABAT), and they'd have to listen and obey him -- no more rewriting scripts for social justice bullshit, no more half assing voicework, no more LOL GAY jokes, no more Casting Couch.

I'm... less sure Sabat is very much important anymore. After the whole audio leaks thing, I have noticed that Sabat has become persona non grata on official material, then we have TFS suddenly deciding they don't want to do their thing anymore out of the blue. The impression I am getting is that Sabat appears to have lost a significant amount of power in Funimation, probably due to Toei contacting Sony directly to ask "The fuck".

This then ties into settlement... an apology, an offering of money, and some largely pointless but still public chastisement would be my bet. Sony will want this gone and the chucklefucks at Funi basically stripped away any reason for Sony to express loyalty to them to lessen the blow.

This is the ideal, but a bit overly optimistic. While Sony is definitely not happy with Funimation they still have some level of face they themselves need to maintain. If they go full "Give Vic Everything" then they raise questions of how something deserving that kind of payment happened under their watch.

Who is he writing a pleading to anyway? He’s done at the District Court, and COA doesn’t do pleadings. They want the briefs.

Rackets thinks it's a pleading for another case he's arguing and not this one, which was told to me after I made this post. I don't know what's going on, I just pass along the information as best I can.

Sabat is definitely less important than he thinks he is. His " importance" is in large part due to the studio.

A subsidiary of Sony not realizing they can get similar results on voice work with few decent mics and pop filters, a modern pc or laptop, an audio software licence, a recent grad of a local audio engineering program who had eyes on the Texas music scene and maybe a couple of thousand in construction costs for things like baffling and an actual booth (which can be cheaped out with egg cartons and a closet) really indicates that they're not thinking this through with an eye to cutting costs. Maybe $5000 up front and probably a lower hourly rate going forward to keep his drama out of Sony's headlines? I am shocked he hasn't been quietly cut out already

Awww... And I had briefly hoped Lemons or Ron would finally try to sue Nick.

Lemon Hitler has successfully obtained and used a law degree for many years. He knows it's just a waste of time to sue Nick. Ronnie, on the other hand, is vindictive and controlling enough to try it if only Lemon Hitler didn't already have a marker on everything he owns

I misread this as
"Lemon Hitler has successfully obtained a used a law degree."

And i believed it for moment, im just waking up.

i know one party that will want to settle if they get past CoA.

I don’t care about the case after that, I just want to see Marchi having to work $5 handies to pay Sam Johnson.

Isn't Marchi the safest one in this? If I remember correctly, she got that feminist organisation paying part of her defense, and her lawyer is actually affordable and competent.

I get that this is the most likely scenario, but then there is the issue of the other defendants, what would Funi do to them? Leave them working for Funi because what they did was not really that big a deal? Firing them considering they don't condone harassment?

If they didn't do anything to the other defendants I honestly don't see any settlement they could offer as worthwhile, because then any detractors of Vic could say that Funi was forced by Vic to say that and the other defendants not being fired is a show of that.

But then again I don't know if it's illegal to condition Funimation into firing and calling their former employees liars as part of a settlement.

Vic has already been thrust into the gossip mill over this, he must understand at this point that no matter what statement comes out, the person making it has no control over how it's taken by an audience

However, the statement would be useful to him booking work with people afraid of having a sex predator on the job site, and an addendum to it that goes " we would be open to working with Victor again if the right project appeared" would also help in that respect even if they never follow through. Such a statement costs nothing, has no future obligation, let's Vic keep his career and reputation even after parting ways and the fact that Funimation has never offered that clarification even after lawyers were brought in is telling

The case is really not at a stage where anyone's focus should be on vengeance, reparations or settlement. Ty is effectively begging Chupp's boss for a do-over

I think that Funi's future depends on what if anything Sony does to them if they lose or settle. Funi's hand may get forced if the fallout makes enough noise or it costs enough money. Denbow's investigation coming out in discovery might be enough to make Sony take a more active roll in all of this. Now it's no longer a subsidiary, their name is attached to a scandal. I have little doubt Funi wouldn't happily continue circle jerking in the den of degeneracy they've created until some external force pushes them. Remember also that according to the info we have, Funi's CEO was told that TCPA will make the lawsuit will go away and they won't have to even pay legal fees. Everyone wants to keep the status quo. Getting past the CoA should provide some sort of shake up from him. Now these idiot's shenanigans will have cost him money and other parties have dirty laundry to air.

The winds of shit are blowing and they're so thick that nobody can plot a course through them thanks to the discovery abuse and the fact we're dealing with retards all the way down.

Honestly, I don't think this will be enough. If Vic wants to slam dunk weaker charges (like the conspiracy charges) against the other defendants or potentially bring other parties into the suit, he's going to need more than that.

The heads of the other defendants, and Sabat, on a silver platter: Any HR documents. Any emails that went through the Funimation system. Any internal communications. Any internal Slack communications. Private recordings they might have.

This would make sense to ask for in a settlement as it helps Vic build his case against the other defendants and bring the case to others not currently in the suit. Having Funimation actively cooperate with Vic on his case would be much more damaging to the defendants in the aggregate than just having Funimation offer an apology and clarifications.

How effective just a vocal apology will be at this point is questionable; the stigma formed from the kinds of accusations leveled at Vic tends to follow people, even if they are shown to be bullshit after the fact, and I suspect that the industry is as incestuous and leftist dominated as other entertainment industries are. Proof showing the conspiratorial acts of the defendants would go a long way towards removing any further (reasonable) doubts, and undermine the no doubt ongoing rumor mill grapevine that has been swirling around the industry regarding this man.

Money. Guaranteed roles. His job he was about to get as Voice Director back,

Money was probably never Vic's goal, but its probably unavoidable that he would ask for that at this point to help with expenses. I could also see him being guaranteed roles at least for the characters he's most well known for playing (any future Broly appearances Funimation handles, any future Fullmetal Alchemist works, etc.). Not sure if Vic would want to work with a company that threw him under the bus, even a high position.

The case is really not at a stage where anyone's focus should be on vengeance, reparations or settlement. Ty is effectively begging Chupp's boss for a do-over

Of course we aren't at that stage. We still have to get through appeals. But Ty isn't really begging the appeals court for anything; even Chupp seems to think this will end up back at his court eventually. Barring an unforced error by the plaintiff's lawyers, SOMEBODY is going to get dragged back into this case.

Unless Funi actively wants to ruin Vic, it is just inexplicable why they didn't just offer a clarification statement. In fact, them settling out for a statement if the appeal is granted would be one of the funnier possible outcomes. Take the legal cost out of future raises and benefits, and the other two (or three) are on the hook for life destroying legal fees
