Just a little something I noticed and wanted to make a comment on. I’m watching Nick’s stream from last night. They get to the second video is Toye’s (which I guess is pronounced Toy which make the insults almost too easy). Nick starts up the video at 3:45 in after a break (02:13:14 for the livestream) and Beard asks Toye:

B: Are you a religious man?
T: Yes.
B: What denomination?
T: Christian.
B: Any particular denomination of Christianity?
T: I would say non-denominational.

This seems really weird to me. What Christian when asked what denomination they are responds “Christian”? For those not aware denominations are many and differ, sometimes greatly, in their interpretation of the Bible. Even a non-denominational knows to answer non-denominational when asked “What denomination?”. Maybe it’s nerves or maybe he’s a lair I don’t know and can’t say. Everything just kinda ground to a halt for me when I heard that little exchange.

I think that is an answer for someone who is not a practicing Christian. Doesn't go to church but believes the Bible type. Or is a liar, one or the other.

Ron isn't Christian, and is likely using it as a sop to try and avoid the accusation that they went on their rabid attack of Vic because of his Christianity.

He won't be directly harmed by all the "I don't remember" shit and that isn't an incredibly unusual strategy.
I don't know about that. Maybe a judge will understand that this is simply part of his legal strategy not to confirm anything that he does not have to confirm, but a jury will immediately assume, as we all have, that he is lying by omission. The Reagan meme immediately makes you think "oh, he's lying" without even knowing anything about the context.

I'm not sure if it is really such a common strategy. Or at least, Soy must have been executing it incorrectly, because Ty seems so incredulous. "Like, really, are you going to vaguely acknowledge your twitter handle but not authenticate any of these tweets?"
 
So here's my store brand bootleg body language on Ronald McSoye III:

He holds himself very meekly, there's no confidence in him at all, when it starts out he has his hands on his thighs or just generally out of sight, likely to absorb the sweat from his palms due to the nerves. (So much for being a sheepdog).

He tries his best at looking calm and collected but....

Rapid, continuous blinking, this continues throughout his entire deposition.

During the opening statements of who is present and what is being done his eyes cannot rest on one person, or one spot to indicate calm, his eyes dart constantly.

Before he's even sworn in, he's gulping and licking his lips due to how dry and nervous he clearly is.

Later into the deposition, he desperately tries to hold his gaze on Ty when answering questions but blinks a bare fucking minimum of five times per sentence.

Meaning he's lying and lying continuously. Plain and simple.
Can others of the big brained KF panel (who are deep diving law) give their thoughts to Ron's performance shown today. I think it'd probably generate good discussion for the thread.

I'd like to skip the next 30 mins of Ron not recalling tweets and get into the what i suspect to be real juicy section. He was not enjoying his time and that was only the first 1.5h with 3 more to go.

My takeaway from looking at it? I can count the number of times he was not being deliberately evasive or outright lying on one hand. The most truthful thing he said was when his face lit up with a glow as he delivered that heroic "America Sniper" bit about being the Sheepdog. There is no way a sane lawyer lets this fool get in front of a Jury. Everything about him said "I am a lying weasel". His performance told every observer that he clearly is, just what eveyone thought at first glance. he is a petty little man with a grudge, seeking to be m'lady's hero!

I haven't finished watching Nick's latest stream but I've noted a particular point when Soye says he's given his lawyers "all they asked for". Here's the link with timestamp.

For anyone who has watched the deposition it should be obvious what strikes me about that but for those who haven't: all throughout the deposition, Soye is playing mind-and-word-games to get the "right" statements out and not his real thoughts and opinions. This is what led us to hilarious scenarios like him saying both yes and no to the same questions multiple times, saying "no" to "will you repeat this answer for me" and silly things like "it's fair to lose your job if 2 people call you a pedophile".

When he very suspiciously remarks that he's given his lawyers "all they asked for", it seems to me that, for a moment there, he's just going with it and automatically mind-gaming his own lawyers too, implying that he is trying to make the "right" statement that he's given them all the info he has, when really he has only given them the materials "they asked for". Big difference!

For the whole deposition, we can see Soye playing mind-games with Ty and losing hard with a smirk on his face, because he's such an imbecile - but apparently he's that much of an imbecile he's also actively and knowingly playing his team too!

An aside: have the depositions been released in text? I'd want a copy of it but I don't know where to look or if it's been posted.

Where it will bite him the hardest is when the question of where Ron got his opinion of Vic. Nick spelled it out quite clearly, he screwed himself because now he can't use anyone from funimation as the source of his information. Because he said on the record, he didn't remember.
Yeah this is the thing most of kickvic are doing their best to ignore, he apparently doesn't remember posting any tweets, so he can't say he had a good reason for doing it. He can't defend why he tweeted the things he tweeted, that makes it so Ty can use those tweets any way he wants abd Ron can't really pedal back and try to defend himself.

He can't remember any conversation about Vic with any person from Funimation, he can remember that Vic was painted in a negative light but no details, that means if they try to argue actual malice that lack of memories only supports actual malice since he had no sane reason to suspect Vic of being guilty.

He thinks that people should be fired if they are accused whether there is evidence or not, and that collusion between investigators and accusers in not possible, so his defense of civil conspiracy is going to be interesting "you see my client could not have done that because he thinks it's impossible to do such a thing".

IANAL, but I would say no, because of impaired judgement/coherency. It'd be like tagging a surgery patient with a sexual harassment lawsuit when they're coming down from the anesthesia and tell the nurse how nice her tits are.

Yes, voluntary intoxication is no defense against defamation. Or more or less anything lately, outside of some very narrow exceptions. If you get drunk and fuck up someone's shit, you still have to pay for it.

It would be easier to avoid litigation though wouldn't it? If it was only due to being drunk I assume you could immediately reteact the statement, apologize, ect. So unless it was some serious damage I wouldn't think it would often end up in court.

Yeah. Plus, it would be hard to do the same level of coordinated defamation and TI in this case while under the influence, so whatever is said probably wouldn't be as damaging.
