NYT article dijo:
WASHINGTON — The Supreme Court on Tuesday revived the Trump administration’s policy of barring most transgender people from serving in the military. In a brief, unsigned order, the justices temporarily allowed the ban to go into effect while cases challenging it move forward.

The vote was 5 to 4, with the court’s five conservative members in the majority and its four liberal members in dissent.

The administration had also asked the justices to hear immediate appeals from trial court rulings blocking the policy. The court turned down those requests without comment.

The policy, announced on Twitter by President Trump and refined by the defense secretary at the time, Jim Mattis, generally prohibits people identifying with a gender different from their biological sex from military service. It makes exceptions for several hundred transgender people already serving openly and for those willing to serve “in their biological sex.”

The Supreme Court granted stays of two other injunctions, issued by Federal District Court judges in California and Washington State, both in the Ninth Circuit.

Solicitor General Noel J. Francisco, representing the administration, had argued that the stays were needed to address a troubling phenomenon.

“It is with great reluctance that we seek such emergency relief in this court,” Mr. Francisco wrote. “Unfortunately, this case is part of a growing trend in which federal district courts, at the behest of particular plaintiffs, have issued nationwide injunctions, typically on a preliminary basis, against major policy initiatives.”

“Such injunctions previously were rare, but in recent years they have become routine,” he wrote. “In less than two years, federal courts have issued 25 of them, blocking a wide range of significant policies involving national security, national defense, immigration and domestic issues.”

Mr. Francisco did not ask the justices to address a separate injunctionfrom a federal trial judge in Maryland, but the Supreme Court’s action on Tuesday will presumably cause lower courts to stay that one, too.

Advocates for transgender rights welcomed the court’s decision not to hear immediate appeals from trial court rulings blocking the policy.

“In declining to hear these cases, the Supreme Court saw through the administration’s contrived efforts to gin up a national crisis,” said Jennifer Levi, director of the Transgender Rights Project of GLBTQ Legal Advocates & Defenders.

“Unfortunately,” she added, “the court’s stay of the lower courts’ preliminary orders means that courageous transgender service members will face discharges while challenges to the ban go forward. The Trump administration’s cruel obsession with ridding our military of dedicated and capable service members because they happen to be transgender defies reason and cannot survive legal review.”

The policy is complicated, and there is some dispute about its precise impact and timing. Broadly speaking, transgender people already openly serving may continue to serve once the injunctions are lifted. But those who seek to transition or serve openly after that happens risk discharge.

The Supreme Court’s rules say it will review a federal trial court’s ruling before an appeals court has spoken “only upon a showing that the case is of such imperative public importance as to justify deviation from normal appellate practice and to require immediate determination in this court.”

he wrote, “an issue of imperative public importance: the authority of the U.S. military to determine who may serve in the nation’s armed forces.”

He told the justices that prompt action was required to ensure that the Supreme Court could rule before its term ends in June. The alternative, he said, was to defer Supreme Court arguments in the matter to the term that starts in October, with a decision probably not coming until 2020.

But lawyers for current and prospective members of the military challenging the policy said there was no need to upend the status quo while the case proceeded.

“Transgender people have been serving openly in all branches of the United States military since June 2016, including on active duty in combat zones,” their brief said. “Transgender individuals have been permitted to enlist in the military since January 2018.”

“The government has presented no evidence that their doing so harms military readiness, effectiveness or lethality,” the brief said.

The hundreds of people grandfathered in under the new policy, the brief added, “cannot be squared with the government’s claims of urgency to eliminate all other transgender personnel.”

Kerri Kupec, a Justice Department spokeswoman, welcomed the Supreme Court’s revival of the policy.

“We are pleased the Supreme Court granted stays in these cases, clearing the way for the policy to go into effect while litigation continues,” she said. “The Department of Defense has the authority to create and implement personnel policies it has determined are necessary to best defend our nation.”

In a statement released Tuesday, a Pentagon spokeswoman said the program was not a complete ban and that transgender troops would be treated with respect and dignity.

“It is critical,” Lt. Col. Carla M. Gleason said, that the Department of Defense “be permitted to implement personnel policies that it determines are necessary to ensure the most lethal and combat effective fighting force in the world.”

The department’s “proposed policy,” she said, “is based on professional military judgment and will ensure that the U.S. Armed Forces remain the most lethal and combat effective fighting force in the world.”

Some veterans groups said the Supreme Court’s move will complicate the jobs of military commanders who lead transgender service members.

“Based on earlier policy, they’ve openly declared themselves transgender, and now we’re going to kick them out for being honest, only to possibly see this ban reversed at a future time,” said Jon Soltz, an Iraq war veteran who is now chairman of VoteVets.org, a liberal veterans advocacy group. “The Supreme Court has made it harder for every commander in the military, today. They’re literally going to have to look at some of the best troops we have and kick them out for being honest about who they are.”

Aaron Belkin, the director of the Palm Center, a research and advocacy group that focuses on sexuality and the military, said the military officials retain discretion over personnel policies.

“While it is unfortunate that the Supreme Court has allowed military discrimination to be reinstated, it’s critical to understand that the military is not required, and has no need, to reinstate the transgender ban, which would cause destabilizing whipsaws in personnel policy,” Mr. Belkin said.

“The Defense Department should not reinstate the transgender ban,” he said, “because it would undermine readiness, cause significant disruptions and uncertainty, deprive the military of much-needed talent, and wreak havoc with the lives and careers of the 14,700 transgender troops bravely protecting our nation’s security.”

y'know when I drank the troonaid I was mad about this, but it clicked for me. They ban trannies because they're very mentally ill. There are plenty of stories where some break down into a 30 minute crying fit upon even glancing their genitalia. You can't have that sort of person in a warzone or even working a desk job, if the Ratking is anything to go by.
Agreed. PBS had some man jaw crying in an interview last night, insisting that he spent his twenties suicidal, until the day he got his first estrogen pill that cured everything. He gave off extreme Jake Alley liar vibes, but if you took him at his word, he is/was a complete nutter.

What is the T doing in LGBT anyway? It increasingly feels like it doesn't belong there.

I think back to the Boys of Pointe du Hoc, whose commander told Ike, I can give you 24 hours, then we've got no fight left and yet held on for a week with no support or resupply during Operation Overlord, the heartbreaking story of the men of the 77th MEF in the Meuse (the "Lost Battalion") who held out for a week against heavy German attacks, the Army and Marines who defended Khe Sahn for an entire month with nothing but ammunition coming in and wounded going out, the Marines who watched their transports being sunk in the straits as they fought for Guadalcanal, and knew they wouldn't be receiving supplies nearly as quickly as they needed...the trapped forces in Belgium during the terrible "Battle of the Bulge", the list goes on and on.

And these dumb motherfuckers who apparently commit suicide at a rate of forty gazillion every nanosecond, who need medical dildos to hold a wound open because their wrecked bodies' physiological systems are desperately trying to heal, and need to gobble estrogen just to be able to face the reality of living in tRuMp'S aMeRiCa, they want any reasonable person to believe they're sane enough to perform any kind of military duty? This pack of self mutilating retards can't even get through a goddamn video game store without throwing a tantrum.

In the past it was mainly gay men who transitioned so the T was attached to the lgb. Now it's infested with trenders and fetishists and is fucking toxic.

It doesn't belong to the lgb anymore. It's now a cancerous growth that is hard to get rid off.

I've had this kind of discussions with feminists before.

Men: Look, war approaches. Maybe I should go to fight to defend and protect my family, my wife, and my kids so they wouldn't be captured by an enemy that will either slave them or get them killed. I know my wife is capable, but I'd rather she stays here, protects my lands, my family, our world, and stays safe so I can always returns to them after making sure our people will have a chance to survive.

Feminists: OMG, MEN HATE WOMEN, THEY LITERALLY THINK WE'RE INFERIOR TO THEM SO THEY DON'T WANT US TO FIGHT!!
It becomes misogyny when your strawman makes the decision for his wife and all other women. Even if the case of a large-scale wartime draft (which is a massive infringement of human rights, prompted and justified by emergency, that won't be happening anywhere in the first world), it's the state who decides to preserve the precious vaginas for breeding, not the individual man.

Given the realities of daily maintenance of a neovagina, it's understandable that the military would not want to accept MTF people. They'll refuse to take you for much, much less, including being reliant upon many widely available medications.
I can't speak about FTM people, but if they have similar requirements to dialation, then it's perfectly understandable why they might be excluded on purely medical grounds.
FTMs go nuts from T. For example, it is a known fact they adopt male patterns of criminal behavior. They're "toxic masculinity" personified.

Just looked up estimates of number of troon adults in the US. They just doubled the estimate from a few years ago, so I suspect it's a garbage statistic, but 1.4 million is the current number given.

How the fuck does such a small number hold such sway? IdPol of course, but it's ridiculous.

If the population of Cleveland or wherever wandered around the country fucking up the imstitutions of entertainment, education, justice, and the military to this level, hell even fucking up the LGB communities and feminist groups, they'd be marched back to Cleveland and a wall would be built around it in a day.

It's a really fucking weird thing, really.

Trans is a mental illness while the others are sexual orientations. You are supposed to treat a mental illness with medication and therapy. Not dick and boob choppin's.

I don't understand how modern medicine thinks that mutilating a patient is the way to go on this. You'd think the Hippocratic Oath would prevent this kind of surgery from becoming a reality. They will never be the gender they think they are and it's usually very obvious, especially with trans women. It creates a lot of discomfort amongst normal people because it triggers the inborn instinct to be wary and disgusted by other humans who are not quite right. It's just part of natural selection. But it's been modernized to include man-made horrors as well as Mother Nature's blunders.

As I've said before, I think that there is something inborn in women that tells them strange men in women's intimate spaces is potentially dangerous. You have a bunch of women in a women's locker room in various states of undress and here comes Stephanie Bustcakes with "her" unsightly growth swinging to and fro. It's very very uncomfortable and being scared is not transphobic. It's a natural reaction to having a strange man in a women only intimate space.

Some trannies like to claim that many women accept them. But I think that much of the time those women are just being polite and don't want to be screeched at for being transphobic and have their lives ruined. And if you look at the Gamestop troon meltdown video it happens to men too. Anyone who can't see you for the stunning and brave woman that you are is in danger of being on the end of a tranny meldown that can become potentially dangerous. The employee was lucky only displays were knocked over.

Also, transwomen need to dilate several times a day. How the hell you gonna do that on the battle field? You can't.

What are they supposed to say? "Excuse me, can we stop the battle for a few so I can go stick this therapeutic dildo up my fake cooch so it doesn't close up?"

:lit:

If conditions with mutilated or deformed genitals bar you from military service then that means trannies are part of that. HRT must be taken regularly and they don't want people who are reliant on medication for the long term. Dilation also has to be done several times a day and this will get in the way of service since they can't just stop operations so Mary with the five o'clock shadow and size 15 feet can set up her mobile dilation station.

Yes but what did she do?

Provided a wonderful role model for conduct to all service members in every branch of the military.

In December 2009, flipped over a table and made a grab towards the gun rack in the room during a counseling session, less than two months after being posted to Iraq.

In May of 2010, assaulted a female intelligence analyst.

Also in 2010, emailed a selfie in lipstick and a wig to a superior officer. Was later found curled up in a ball in a supply room with a knife, having carved "I Want" into a nearby chair.

Throughout 2010, downloaded classified documents to send to Wikileaks.

And I presume he's been a hero to the left ever since he trooned out.

I don't see how a tranny is any more mentally ill than a bunch of retarded hicks who willingly choose to die in the desert to 'defend muh freedumb.'

If they want to die Iraqistan or whatever, I say let them. The US has pretty much lost every war it's been involved in over there, so it's not like they'd negatively impact the outcome of the war.

Either this is shit bait or you're legitimately dumb.

I think it has a lot to do with the high suicide rates among transsexuals/transgenders and more extreme examples like Bradley Manning, as posted earlier. A dumb hick in the squad is just a dumb hick, they might not follow orders well, they might not be able to carry out super complicated tasks, but unless they go full Vincent D'onofrio in Full Metal Jacket they're not any major risk and if they're good natured they are great for morale. Whereas with a transgender person not only are they a logistics nightmare ( as stated earlier) but they are usually extremely unstable people in most aspects of their lives. Would you rather be in a foxhole with a complete doofus that 100% has your back or Macho Ma'am Tranny Savage that already had 2 violent psychotic episodes this month and tried to give you a blowie in your sleep?

The same reason it was a bad idea for McNamara to conscript people with 40 IQ into Vietnam. They get non-retarded people killed.
