Apparently this is only the judge ruling out one of the two claims, this being the reaction video itself being copyright infringement, the other claim being denims awareness and organizing with the mods. Ethan's lawyer can argue against it but i heard the chances of reverting the decision are low.
I admit i did not think Denims had a chance, but mostly because if she actually wins this then this will open another pandora box of fair use law where watching entire movies while pausing in between to comment on it will be legally defensible and corporations wouldn't let that fly.
I'll point out that h3h3 is losing because basically all the the arguments HE CREATED for fair use are being used against him. His lawsuit against hoss was brought up multiple times

This was flagged at the time as a potential risk for the lawsuit. I'm pretty sure Ethan's lawfare expectation was that the accused wouldn't be able to afford to defend themselves, so they'd all have to agree to settle with humiliating apologies and restrictive non-disparagement clauses (like Kaceytron did).

Ok yeah that makes a lot of sense. It just goes to prove how much of a SLAPP (at least in intent) these lawsuits are. Everyone know that he is just trying to rape them financially, which explains why the claims seem designed to be read as an epic reddit tier takedown on his podcast. Like how neurotic do you have to be to write that trash in a copyright lawsuit.
He truly believed the Content Nuke would destroy Hasan (it didn't even move the needle) and his admittedly clever trick of pre-registering the nuke in the Library of Congress meant it was a one-and-done and everyone involved would fold. It emboldened him to write a bunch of things so he could farm it for content - remember he thinks (or at least thought) his own flagging career was the result of a giant snark conspiracy between these people. It was such a success in his mind that he was planning a second content nuke exclusively discussing Hasan's sex life, down to what pornography he thinks Hasan likes, although he clearly shelved that as it undermined his insistence that he's not psychosexually obsessed with Hasan (or involved with Destiny, who still wants to have gay sex with Hasan).
The real question is what happens to the other lawsuits. Frogan apparently isn't defending herself because she wagered statutory damages would mean she wouldn't get humiliated through a settlement and would cost less than retaining lawyers, and the purpose of the Snark lawsuit is to subpoena the Snark mods and expose their identities instead of necessarily winning.
