Actually Native Americans aren't considered "US citizens" exactly (including by the 14th), they are effectively considered a super sovereign secret category in which each tribe is effectively its own mini-sovereign in the US. This was in the oral arguments today. (Yes this doesn't affect the Indian Citizenship Act of the 20th century however)
It's actually much worse. What he's saying is, effectively, that we would have to evaluate *every* citizenship going back to 1848 (or whatever year the 14th amendment was passed) and evaluate if the ancestors of current US citizens were in the country illegally or on a non-immigrant visa *then*. If they were, then their offspring are no longer considered US citizens. So, your great-great-grandfather came here as a doctor on a work visa (non-immigrant) and had children and eventually decided to stay? Yeah sorry your entire family tree no longer is US citizens, and you'd need a different reason to regain that status other than birthright. This is something that the court also argued and grilled the SG over but I don't see it discussed much.
