The original video was posted to Reddit on r/instantkarma which did not originally have a caption (and was a lot longer). This is family drama and the caption was edited to have that content in there.

Looking back at the footage from the other angle, the man that shot him (circled in red) had a clear view of the man as he was on the ground. In fact he was standing right beside the man in gray (circled in blue) as he grabbed the gun from the waistband. The shooter would have had an extremely clear view of the gun being removed from that perspective.

He also wasn't just randomly approached, even the videos edited down to keep things brief show that he was constantly on ICE's face and doing that fag dance of "legal observer" by getting in their way and trying to block them. He chose to block their way and make himself a target multiple times. He had many chances to step away from them and every time chose to escalate.

There weren't even any somalis around for him to defend like the race traitor he was. He just chose to go up to and shadow ICE, staying so close the agents were practically tripping on the guy as he kept trying to walk exactly in front of them to block them.
