I've mentioned this repeatedly. Nick's representation was incompetent, but Fischer's behavior was frankly deplorable. Punishing someone for having legal representation, or even the appearance of doing that, is completely improper and even unconstitutional.

I mean this particular evil bitch really did deserve to have the book thrown at her, but the reasoning here was pure Minnesota. The state is fucked.

Also she didn't pay for an attorney. Apparently Nick was pro bono. I have no idea how this arrangement came about. But instead of properly objecting to this in court, he confronted and chimped out at the judge AFTER the hearing instead of getting it on the record for a possible appeal. Pure incompetence and malpractice.

This is not a motion, it's a sentencing hearing where Nick asked for downward departure (i.e. a sentence lower than what the sentencing guidelines suggest) on the time his client would be sentenced. Judges are generally not tonally neutral when delivering a sentencing. The judge is supposed to provide rationale for the imposition of the sentence and that often involves a moral condemnation of the person's character and/or why they lack mitigating factors that would justify a lesser sentence.

I don't mean to be glib, and maybe judges should be a little more even-toned, but in practice, many are not. I would go as far as to say that most are not, and many judges are far more fire and brimstone than Fischer was here. Sentencing hearings across the country will generally be similar in tone to this one.

No, it's his half truth bullshit. Most likely he fucked up the time when they were supposed to show up. And no one gets family time after being remanded to the sheriff. Judge doesn't determine that.

As for holding "paid for an attorney," she was pointing out that Nicks client bankrupted 2 families but she still had money. In a just world, all her money would have gone to restitution but lawyers made sure they got paid before victims. The joke was on her though because she got an absolute shit lawyer. That Nick thinks the judge took it out on his client rather than recognizing the absolute shit job he did in presenting his client to the court speaks volumes about Nick the Human and Nick the Lawyer. Absolute dogshit. Nick: "Boy that judge really hated you." Client: "How is that my fault? You don't even let me speak. The only impression about me that she gets is whatever you present. You're shit"

But the irony that Nick never mentions is the misconduct the judge got called out over and retired over. Fischer hated the KCHHS children services group. She called them out just like Nick did. If Nick is right about KCHHS, then Fischer was right.

The amount always has context. Stealing a 75 y/o's life savings of $40k is a lot worse than stealing $1,000,000 from Elon Musk. The judge is rightfully indignant that the thief was still able to afford a private attorney and college when two families were going through bankruptcy. Imagine the victim watching money that was earmarked for their childrens college paying for the defense and education of the thief. We used to hang people for stealing horses and this is an example for why that was a just punishment.

edit: An Ominous pointed out that Rekieta did it pro bono but was too much of an incompetent retard to bring that up on the record when Fischer mentioned paying him. Against all odds, Skelly was demonstrably worse than the public defender which would have conveyed indigence instead of privilege to the court.

Sentencing doesn't just take account of the pure money value of some scam, but also on the impact to the victims. In this case, it was literal life-ruin shit. She destroyed small family businesses and wrought havoc on the lives of the people she swindled. Hence, the sentence itself was appropriate.

It has devasted her family. Reoffending is out of the question. I think some people do like moralising in a judge's sentencing statement, but only if they agree with it in full. Surely, if a law is moral you would want it to be applied and adjudicated morally? That's what the sentencing statement is for, explaining the judge's reasoning in full. "I find this aggravating, I find this mitigating, for all those reasons etc."

You don't like it because it's essentially a string of non sequitur taped together with Nick's unconvincing demeanor. This was covered in some of the scientific papers. All the amounts and limits for the testing are based on adult weights, metabolisms, etc, and are empirical based on interviews. They don't really have a cohort of 9 y/o coke users so while it was at 10x the reportable limit, they don't really know how much cocaine a child would have done to get that level. For adults, the levels correlated to regular, long term use but it could be substantially less for children. They just didn't know.
