You're grossly oversimplifying things. There are other avenues available for a defense, such as challenging the jurisdiction of the court, the legality of the charge of charges, the legality of evidence collection, procedural violations, the whole "criminally insane" defense which is never a good idea, jury nullification, sovereign citizen (lulz) etc.

It's more than just the three options you mentioned.
