If my wife goes missing and they find a message from me to a friend, saying "I killed her yesterday," I don't think the court would dismiss this as insignificant evidence, even in the absence of physical, direct evidence like the body or murder weapon. A jury might evaluate it as not strong enough to convict in a later trial, but it would be admissible evidence.
Not to mention that this is a civil case. While it may not be enough to convict in a criminal case it might be enough for them to say "yeah, it seems like he did it" here.

Anyone who stayed after the lav drama was primed to be a cultist. To me that was the normie cull.

im pretty sure most people in dgg just don't know the Ana story. two months ago i went through her KF thread, the max report and available vids that weren't DMCA'd but prior to that I basically had no idea what happened with destiny and ana. Also the nice thing for destiny is that since he hooks up with terrible people it's pretty easy for them to highlight their flaws and let the audience do a both sides thing and say "they both did fucked up shit".
 
He uses the idea of rolling around in the mud a lot to downplay his behavior.

One thing to note though, he very rarely turns his audience against the women on his stream. I've seen figures like JSTLK mistakenly claim this about Ana and Lav. In most cases, he actually defends these women against dgg's wishes quite a bit, often to a point that intensely frustrates his audience. He will do this for as long as he's using them. He does, however, pay close attention to his audience's grievances and then when the time is right he goes all in, flipping sides. This is extremely therapeutic for dgg and they get to feel like they were right all along and that Destiny always comes around to the right conclusion eventually. This also creates an extremely hostile environment for the women because dggers essentially felt locked in a cage, with a crazy e-girl rattling it non stop, taunting them, for however long (sometimes months) and finally their owner has let them loose.

dgg despised Lav and Ana both way before Destiny started fighting with them. He defended Lav for a significant amount of time, Ana fell apart a bit faster. He doesn't need to turn his chat against anyone, because he's throwing insane weirdos who any sane person would hate onto his platform and plus he has cultivated a core community of nuanced incels (center left edition). He does though, eventually, take advantage of his chat's biases when it becomes useful.

He has turned dgg against pxie though completely because he had to. Even the people who found her annoying still generally felt like she was a good person. It's actually one of the craziest people for him to do this shit to because of how positively his community perceived her. He even heavily contributed to this positive perception. She was the go-to example as someone who hadn't fucked him over behind the scenes or acted snakey. He said this like 100 times over the years.

Google has a service tailored for litigation and eDiscovery, that he could have used as a Google Workspace user. This. Civil cases only need a 50.1% (more likely than not) propability that something happened, while criminal cases need a roughly 95-99.9% (beyond a reasonable doubt) propability.

"Not objecting" to something really only matters when you are presented with it.

Imagine the below conversation:

Destiny: "I can't wait to get home and show this video to Melina"
Pxie: "She's going to love it!"

This hypothetical conversation is a fair example of *implied* consent in the way that Destiny is viewing it. She hasn't explicitly said the words "I give you permission", but you can assume given the context of this conversation that Pxie is okay with him showing the video to Melina.

In that conversation, it would be fair to say that Pxie did not object to him showing the video to Melina, because there was something there for her to object to. The suggestion had been made and she implicitly consented to him doing it.

In the above conversation, however, it is also true that Pxie did not object to him sharing it with anyone else. This is an unfair interpretation of the idea of "not objecting" to something. It is also true that in that conversation, Pxie did not object to Destiny roundhouse kicking her in the head.

It is possible to imply consent, but you need to be informed and you need to be presented with it as a suggestion. Most importantly, this only works if you have not given explicit non-consent previously, because this now needs to be withdrawn.

The problem for Destiny is that Pxie DID start out with explicit non-consent.

The video of Pxie is of her face the entire time and she is easily identifiable in the video, so it would fall under the umbrella of "having sex" that Pxie had explicitly asked him to keep private between them.

She claims that she explicitly withdrew this non-consent with regards to Melina. Both parties agree on this as Destiny also claims to have told her that he would share it with Melina.

Destiny is then taking this explicit consent to share with Melina, and using it to override her explicit non-consent for sharing it with anyone else.

I cannot stress enough that the person he sent it to was practically a stranger to him. We also know that she was a fan, so could have easily identified Pxie.

This is similar to someone saying:
"You aren't allowed to have any of my money."
A few months later this person gives you 5 dollars.
You cannot use this as permission to take their life savings without their knowledge.


Furthermore, I'd like to point out that a higher degree of affirmative consent is required in this scenario than during sex.

During sex, both parties are aware of the situation and either party can withdraw consent at any time to end the sexual encounter.

Sharing videos typically happens without the express and immediate knowledge of one party. Consent is given in advance of anything being sent. Once the video has been sent it is a permanent record that can be saved, downloaded, recorded, etc.


As it stands right now, Destiny is throwing out random quotes about consent being confusing in his chat, with the hopes of it muddying the waters.

To quickly address the claims of Pxie sending the videos to her boyfriend without explicit consent.

Forgetting the fact that this information had already been in the court documents for quite a while, Destiny mentions that he and Pxie had "conversations" regarding the sending of it to her boyfriend, and that it was implied/expected that she would send it.

The nature of these conversations is important, obviously, though even if Pxie sent the videos without any level of consent, given that he only found this out recently it couldn't have had any impact on his justification to send the videos to anyone else.

I will say however, there is an argument for Pxie demonstrating an implied consent for Destiny to send it to anyone. If Destiny can provide any evidence that Pxie sent the videos to other random people, this would be better evidence towards the idea that Pxie understood that there was consent to share it with strangers you'd never met. As it stands right now it only furthers to support the idea that she consented to Destiny sending it to Melina (his equivalent to her boyfriend), and nothing more.
 
In the analogy Destiny getting black out drunk after chicken and waffles makes the consensual cocksucking of Fuentes truly such a grey area. How could he know if it was consensual if the waffles were no good.

Obviously, it's an extreme prediction, and wouldn't be surprised if I'm wrong, but everytime he's talked about that event he has been scared/ashamed to go into detail about what exactly he said to her that he would do if she didn't pack her stuff and leave.
To me there are two possibilities, he either threatened to go physical/beat her (which I don't see happening as Melina would beat him up in any fight) or he threatened to actually kill her, which goes along with Destiny's claims that he knows she started to tell her friends she no longer felt safe there.

Both times he's talked about this drama he's made slight reference that maybe he made a threat.

One of the last in-person interactions Melina and Destiny ever had was him seemingly threatening her (and possibly her life) if she didn't leave. We know he's admitted to choking his 1st ex-wife, and we've seen him make threats towards Kuihman and jstlk. So in addition to being blackmailed by Destiny, it's possible Melina also fears violence from him and his cultists if she speaks out.
