So I have spent over four years in a legal dispute that resulted in the biggest joke of a trial. The result was both me and the other party lost. The jury went with the comedy option. But one thing my legal firm did do was stay away of appeal issues and the one thing that was stressed WAS PUT SHIT INTO THE RECORD!

Judge wont allow a report in because he doesnt trust the documents its based on? Well we almost forgot to move to have those documents moved into evidence, also had a dude make very nice speechs and do offers of proof, with nothing but the point being "GET IT INTO THE RECORD"

The fun part would be the judge would ask for briefs and while my guys did honest research the other would just copy paste and not even change formating from some law reference with no legal arguments

I imagine the court of appeals was hoping the case would go away but they finally came down.

I guess it was a good thing Ya Boi Zack dropped his case from comics gate.
 
Doubtful almost all the money was likely gone. And stealing a clients money is the kind of thing you don’t do. You’re are saying Ty wanted more money out of a vastly dwindled 280-300k then he would out of the multimillionaires he regularly deals with.

It was idiotic whrn KV first claimed it and it is still idiotic now.
The only way to judge how "vastly dwindled" a warchest is is to see how much was taken from it and what bills were involved. Then we would look through it and see if the billed amounts are correct for the work being done. If none of the GFM donors are doing so then they are bigger chumps than I thought.

The reason I think there is foulplay involved is because notarizing a document is legitimately one of the basics of business conduction anywhere on the planet. And as such, notaries are literally everywhere, so why would Ty insist on notarizing everything himself? The notarizing would hold anyways and it's a small fee that can just be charged to the GFM with accompanying documentation. His reaction of withdrawing the affidavits asap is also very suspicious and really fucked his client.

I also don't know why you would assume that KV has anything to do with anything I say though? I follow none of the tardlets involved in this, I just check back every once in a while to see if new docs have landed, which in this case they finally have and the verdict is what anyone with a brain would have thought it would be.
 
It doesn't work that way in real life. If someone who hates you gets their friends at CNN to put out a report saying you enjoy raping and murdering children, what are you going to do about it? You can say you're a good person all you want, but you're now forever that dude who rapes and murders children.
You can always try pointing out those accusers are either full of shit or were/are willing to allow children to be raped and murdered because they never bothered to call the cops.

The simple answer was Ty didn’t think there was an issue with them and when it was pointed out there was no time to correct and resubmit. Although considering the clients he usually has I don’t know how he could ever screw up this bad.

Firstly; wouldn't it be the Ty's firm that gets sued for malpractice rather than Ty personally and, can't honestly say I remember, didn't Ty's firm produce all of the relevant documents?

Secondly; isn't voluntary assumption of liability something that can result in an insurer disclaiming the liability? Maybe Ty notified the insurer of a potential liability and had the insurer's consent to acknowledge fault at that time though that seems unlikely.
The document thing was according to Nick. He said someone else in the firm had done those two documents, while Ty personally wrote the second amended petition.

It would depend on the exact company and exact policy, but insurance covers negligence, just not willful acts. If Ty had said he deliberately fucked up because he hates Vic's pants, that would ruin any insurance claim. If his position is simply, I fucked up on accident, that's exactly what insurance is for.

Oh he was. All sides were. And that’s fine. Submitting last minute is ok. Ty’s issue was all his stuff wasn’t ready to go at last minute and the critical evidence is the one thing you make sure you get right well before.

There’s not going to plan and game bs and then there is this.

Reading the room, it seems like even most of the Weebwarriors are inclined to co-sign that now. It's one thing if a lawyer loses a case on merits. Plenty of successful lawyers have taken Ls. Some things are beyond one's control. However, this is something altogether different. Like, holy shit Ty. How could you fuck this up so horrendously bad?

No. Ty's law license permits him to handle this case. He's admitted to the Bar in Texas. All the minimal requirements were met here.

The practice of waiting till the last minute to submit a filing is a well known tactic in the legal community, however under no circumstances should you wait till the last minute to compile the damn thing.

I think that's the general thrust of the complaint here. That it was rushed and sloppy.

As you can see, you cannot do much in court, either, but if you want to change something, start with why is that you cannot survive without corporations that serve as moral arbiters and what you can do about it. If you try to extend the legal system, it will just be turned against you, much like antiSLAPP laws were.
You can do a lot more in court if your lawyer isn't being shitty with deadlines and making retarded mistakes because he's getting drunk off his ass at 2 AM on an internet shock jock livestream.

IIRC the binder was stuff in the first petition that Chupp was too lazy to look through and he just disregarded it. He kept asking for specifics, simply. Ty offered the binder. Chupp refused.

That’s what started annoying me. I think after the first late filing way, way back, and especially when shit hit the fan but before amending. And it was as simple as use the hours you are spending on stream to check your work so that come the morning you don’t have issues like we would end up seeing with the evidence or so the work is done so it can be sent in on the final day with enough time to check submitting works snd you don’t break something

I liked Ty coming on stream but he came on far too often for my liking.

Now I am not a law, but even I as a not a law have had to get people to confirm what they say and sign off on it. And it’s probably better to do that in person as a rule. How Ty, very much a practicing law, can screw up following basic rules I don’t know. From what I can tell, it’s piss easy to do.

Yeah, no shit. I'm sure there's a more than a few people reading this forum that have had to have one or more things notarized in their life. The entire point of the process is to authenticate the genuineness of a document. Of course you can't self-authenticate.

Funny thing is that I remember back before Weebwars, during the Warski vs. Tonkasaw Knoxville arc, Nick took a jaded view towards a notary stamp that Tonka had on something. I dunno, but I find it a little amusing we're talking about chicanery with notaries again.
 
Look I'm not here to defend Ty, but people are acting like he was the only lawyer doing all this work for Vic. It was a team fuckup. Ty, as lead, gets to take that on the chin, and in particular, the notary fuckup and not preserving evidence and objections in court. But there were several lawyers, paralegals, etc. who all dropped the ball along the way. Ty, as owner/senior partner, is ultimately responsible, and at least he's owned up to it. But it's a bit of a jump to act like him going on Rackets streams contributed to losing the case.

Ty's cope from the beginning was his statement to Vic's mom, something about rebuilding Vic's reputation. After they lost the case (the first time), Ty said he felt they had rebuilt Vic's rep. On the whole? I still think Vic ended up ahead on the PR front. He's now doing dubbing again, directing, attending cons. Yeah, it's not the same caliber he was doing in 2018. Losing a civil case obviously doesn't help, and as Cocaine Branca is fond of saying, "Appeals are for losers."

Further on the PR side, outing the depositions was a mixed bag. It proved what kind of people Marchi, Rial, and Toye were, which was eye opening. But it also opened Vic up to some avenues of attack. (Ultimately, it's stupid the TCPA allows for this shit- IMHO if there's a free speech argument to hold up the case, it should be done immediately and no other evidence (like depo's) should be allowed. ) I still think Vic came out ahead for showing the public the depos.

But from another avenue, as others have commented on it, the Kamehacon re-invite probably turned out to be a double-edged sword. It proved Vic did have an avenue to going to cons, which probably didn't help the interference claim. But you don't want to have to threaten litigation to go to every major con.

Yeah, rag on Ty, it's fine. He fucked up. Chupp is a fuckup. But in this case, every lawyer was a fuckup, except for Marchi's.

I like lasagna man. It's shitty he went through all this, but it's clear he was a bit of a Pollyanna about his working and personal situations, up through his Funi dismissal (if not later). From the outside, it feels like he has grown in his personal/business dealings, and I hope that's the case and that AM Studios proves to be more than a passing fart. Star Trek Continues was inspired fan work, and it proves what Vic can do and what he can inspire people to do. I hope we get to see some more of that spark down the line, and that some fat cows and twinks didn't extinguish it.

As for people misinterpreting the outcome, shit there's a lot of that even going on here. It's a burden Vic will have to carry, assuming no further appeals prove successful. But on the balance, I think he still ended up ahead, even without a civil decision in his favor. If Vic can help lead a counterbalance to Sony/Crunchy, that will be a net good. And who knows if AM Studios would be a thing, were it not for Vic being a free agent. He'd probably be stuck in the Sony cogs at this point, considering a move back to LA (or wherever the fuck they dub at).

Uncivil is going to be going over it in a bit. He was a pretty harsh critic of Ty at the beginning of it and was drawn in by the KV fuckers, but in the end turned out he wasn't one of them, shit on lawtwitter and became friends with Nick instead.
