Not saying for sure that it is. Just saying that law school teaches you a lot of ways to say bullshit. And generally, if something can't be reduced to a layman's understanding, there's a chance its intentionally made as obtuse as possible to obscure the truth.

There is a fundamental corruption in the law. I don't think better interpreters of bad laws will ultimately correct the problems with the system as it exists. Anti-SLAPP laws protecting liars isn't a bug, it's a feature, and the bugmen writing these laws knew it when they did it.
This should be a given based on the website on which I'm posting with the multiple lawsuits trying to take it down by attrition, but maybe it should be hard to sue someone over something they said. Don't like what someone's saying about you? Say shit about them. Defend yourself in public if they're lying. Or challenge them a duel, whatever (that shit needs to be legal), but don't drag the power of the state and federal government into it unless you can prove your case and not fuck it up while you sit around stroking your own ego on streams. Which the plaintiff and his counsel couldn't.

Everyone being defamed all the time is better than lawfare. Making it easier to sue people for speech won't make the shitty system better.

I agree to a point. There's two problems, though - first, normal people are deceived into believing that law is a mechanism for redress of valid grievances, so they're not equipped to deal with outrageous and obvious defamation like this. They still think someone is coming to rescue them (granted, that's pretty naive). Second, what useful mechanisms for getting your pound of flesh actually exist anymore? You can't challenge a cad to pistols at dawn - the challenge itself is ridiculous to everybody else and only hurts your credibility (see Tonka, the Gunt, or any other internet toughguy), and if you insist on it convincingly enough, then the bugman law will intervene against you. Maybe the "virtuous" liars using defamation to defend themselves from the defamation of dishonest liars will balance out somehow, but I don't like it. I can't say I've given enough thought to it to be objective about it, but it seems wrong to me.

I completely agree that in a more ideal world not under bugman rule, dueling would absolutely be a component of a more polite society. That's a platform I could get behind.

Edit: to the point that KF is under siege by vexatious litigation, I can concede that there's some potential validity to systemic safeguards against frivolous lawsuits implicating obviously protected speech, but there's another factor in that equation. It's broke retards who are permitted by other elements of the system (in forma pauperis) to keep suits going perpetually instead of getting checked immediately for being a time-vampire and barred from doing it again. Ideally, there should be some distinction between what greer and the mountain jewess are doing, and what Vic did. Not a lawyer, so maybe I should stay on my lane on such issues.

He put forth an idea of a negligent referral lawsuit, where Vic sues Nick for referring Ty to him. There can be some weird confluence of events where Monica and Ron settle with Vic, Vic transfers his lawsuit to MoRon, and MoRon are the ones who sue Nick.

There's also the idea that, because Ty openly admitted that it was all his fault on Nick's stream, that Vic has a case for malpractice against Ty. Ty can then use his firm's malpractice insurance to pay Vic, and Vic uses that money to pay off the TCPA fees. I'd think this is more likely to happen than the appellate panel magically reversing themselves sua sponte or through a motion for reconsideration.

They are an essential part of any legal system, and like anything in the legal system, can be abused, much like anti-SLAPP motions are also often abused by large corporations (i.e. Funi lol), makes a bunch of clutter for the legal system, and arguably is unconstitutional for violating the right to petition.

Secondly; isn't voluntary assumption of liability something that can result in an insurer disclaiming the liability? Maybe Ty notified the insurer of a potential liability and had the insurer's consent to acknowledge fault at that time though that seems unlikely.

How the hell is Nick supposed to predict that someone who had done a pretty good job on most his work, would bungle your stuff to such a degree that it is the sole reason you fail?

As you can see, you cannot do much in court, either, but if you want to change something, start with why is that you cannot survive without corporations that serve as moral arbiters and what you can do about it. If all said window installer did for Nick was say, plumbing work and had nothing to do with installing windows, then Nick could well be on the line for referring his family's retarded lawyers to Vic.

Ty himself being liable to Vic is probably a lock though, there should be no way a lawyer could fuck up something as simple as filing things on time and getting them notarized. The fact that Vic now has a set of legal documents saying that multiple courts disregarded his evidence because of this mistake, which means he has a case against Ty now.

The problem is that now he has to either pay the defendants and that may leave him unable to pursue the world's easiest malpractice case.

Now if you ask me why I think Ty's "mistake" even happened to begin with, my best guess it that it was an attempt to be able to bill additional hours and expenses to the GoFundMe (I have zero sympathy for having a legal GFM in the hands of a 3rd party was such a dumb dumb move on Vic's part, he should have organized this thing himself.). If he just have the affiants notarize stuff wherever they are then he may not be able to bill as much? I dunno.
