That's going to depend on what bullshittery the prosecution pulls for closing statements, but... its pretty bad in general because it leaves the door open for the jury to give in to the idea of provocation to remove self-defense.

But in all seriousness, until the jury instructions actually get read out, I think it's a bit early to be dooming. The judge indicated a couple of times that he's going to take time to make a decision on the matter. He's not decided what instructions to give on one of the earlier counts, for instance.
