Starting to worry that this will be a repeat of the Chauvin case and 2020 election where the autists on here were so sure that their side was righteous and therefor must win. In all three cases(with the possible exception of Chauvin, but I doubt many thought he should've got all the charges) they were half right, failing to realize that the world doesn't work based on who has the better argument or who is "right". As edgy as it sounds, power is the only thing that matters and if you don't have and use power you're fucked.

Can someone explain to me why a mistrial would be better for Kyle than a finding of Not Guilty? Unless it's a mistrial "with prejudice" then doesn't it just mean that the prosecution gets to have a whole other go at it, maybe more competently this time? And my understanding (possibly wrong) is that with prejudice is very unlikely.

I'm not seeing why they wouldn't just leave the jury to deliberate and come back with Not Guilty as unless the jury is very prejudiced against Kyle or feel threatened, it's hard to imagine this not passing reasonable doubt.

Short version: Why would they / have they moved for a mistrial? I'm not saying there's not grounds, I'm asking why they'd want that.

I think most people are hoping for a mistrial with prejudice, that was the argument made by his lawyers yesterday.

Prosecution's shenanigans are outrageous. Is this the sort of tomfuckery they often engage in? I've read some reports that Kraus in particular has a history of being a fucking piece of shit, I want to strangle that motherfucker and gouge his eyes out. Binger I would just set on fire and shit on his smoking corpse.

I hope Chirafasi does presentation or whatever on Monday, he's smart and adapts to the situation quickly. Richards is a fucking dinosaur and takes forever to get to the point, fuck that dude.

They moved for a mistrial WITH prejudice and have a legal basis for doing so.

A mistrial without prejudice could still occur from a hung jury. This is separate from the motion the defense is filing.

Can they actually ask for a mistrial with prejudice specifically, and not just a mistrial which they hope will be with prejudice? Because poor Kyle has been through enough. Can't imagine what it would be like to go through this all over again for him.

So, there are 50 some odd new pages since I was here two hours ago. Instead of trawling through all that, can someone just quote me with what was decided? I figured closing arguments are tomorrow, but did the judge really let the lawyer bully him into finish this shit on Monday?

Closing is on Monday. I think they're arguing motions with the Judge tomorrow.

Monday, both sides get exactly 2.5 hours. Prosecution trying to add a bunch of lesser charges and some bullshit instructions about how if Kyle was provoking people he isn't allowed to defend himself
