If I don't see a proper appeal letter by Wednesday then I'm gonna be mad though. Ain't nothin stopping them now.

They appealed weeks ago, fees are already paid, and since the appeal is now timely, it is deemed as having been effectively perfected today.

I wonder how LemonAIDS is going to explain to them that this is okay after he said in court, and I believe they were there, that he was going to bill them the full $280k for doing a bunch of completely crazy, unnecessary shit that made no difference to the outcome.

Chupp awarded $5k in sanctions each for all three parties. The total of all the parties with all attorney fees, expenses, sanctions and fees for appeals comes to $525,542.42.

If Vic decides to forgo appeals he would owe $238,042.42 right now.

Now I perfectly understand that this has less to do with the TCPA itself and more to do with Lemoinie inflating the bill, but it once again cracks me up just how poorly written the TCPA is. The entire point of the thing is to reduce time and costs, and now even with the defendants "winning" they would still be in the hole financially speaking. Between that and the easily available appeals written into the TCPA, I'm not sure what the point of the thing even is, really

The judge got the unredacted billing on the 21st. Do you really think Chupp wouldn't have asked for it? Do you really think the Defendants' lawyers were dumb enough to put evidence of perjury in their own fees' filings?

I think Ty said it on one of Nick's earliest streams after the case was filed. Marchi was always the weakest case, but she was included to paint the totality of the picture the case originally made: a FUNimation-centered circle of people who were in close contact with each other, who defamed Vic publicly and privately, and coordinated their public actions accordingly.

Defamatory or not, Marchi clearly chimed in to bolster the Vic-as-predator narrative right along Monica. Her status as a Funi VA made it so if she was left out, the first question MoRonica would be asking is, "well why are you only going after Monica and not these other people?" They tried that in this case anyway, but notice Vic had a solid answer of "my friends' statements had the most credibility, and I'm going after the most damaging people".

We already have the e-mails from Monica to Funi HR talking about what she could say publicly, and Ron's Kamehacon texts. I think if proper discovery had been accomplished, BHBC would have found something to hang on Marchi too... but the TCPA frustrated that.
Seemed like Marchi was in there mostly because her tweets showed malicious intent.
I thought it was funny given the timing but I'm not sure it's related. I don't think KV is smart enough to pull it off or have enough disposable income to pay someone to do it. A common trend is low income, in debt, and/or careless with money.

That some of the defendants racked up ridiculous expenses in this case has fuck-all to say about the utility of the TCPA, because they purposefully avoided it as a strategic maneuver. They could have filed for TCPA very early on but instead decided to wait until the end so they could play discovery games. Had the defendants acted within the intent of the act I suspect their much more reasonable expenses would have been accepted by the judge.

This could work in Vic's favor. If appeals are successful and the suit is on again, things could change very quickly.
Already ruinous legal bills plus even further bills on the horizon could force MoRon to the negotiating table.
Of course I'm operating under the assumption that Funimation isn't bankrolling MoRon's defense.

Has anyone ever bothered to listen to his podcast, because he apparently covers this case as well. It's one thing to watch someone make an ass out of themselves on twitter, in written format. It is probably another to listen to them talk about it. Would be nice to see if he comes off as much of a smugfag on his podcast as much as he does on twitter, or whether he whines about detractors.

That isn't really the TCPA's fault. The TCPA didn't force Lemonfuehrer to engage in endless frivolous motion practice meant solely to harass the other side while driving up costs. That was entirely his own doing. Even as it is, the parties are getting a lot more compensated than they should have.

We're still talking what is in substance $50,000 to file a fucking motion to dismiss.

But they'll get to argue about that on appeal.
