I want that to be filed, Chupp to Chupps and not squash it, and Ty to not oppose.

And then file his discovery result with a simple " You will find attached any and all communications requested that do not fall into client-attorney privilege as Exhibit A". And the Exhibit A is an empty white page.

IB4 this is all just a stalling tactic so that the clock gets ran up, and they argue that because so much time has passed the window for appeals is gone.

No, this is them either trying a blatant fishing expedition, or trying to stall out BHBH. Either so BHBH wastes money, fucks up the appeal, or to stall it out so Vic can't sue Sabat due to the statute of limitations.

You is Ty in this. So, this wants:

Any communication between Ty and Slatosch, Huber, and Dahlin concerning litigation. THAT is privileged as it is literally asking the LAWYER to hand over information about the CASE
Any communication between Ty and Rikieta about litigation. Again, asking to hand over information about the case (privileged on TYS end), and privileged as a reporter on NICKS end.

All of this, every single bit, is privileged.

Maybe not all of it but while they may argue otherwise, the way they've phrased it explicitly asks for material that is clearly privileged. Usually the burden is on the party asserting a privilege to present a log of what they claim to be privileged but in this case the burden should be on the party requesting extremely unusual discovery to justify why it isn't privileged.

Well here's the thing. Chupp has made it clear he doesn't like to work. If Ty puts his foot down and says no Chupp will likely just shrug and say less work for him and not enforce it so he can get back to doing whatever it is omegaboomers do.
 
So to be clear... Work product is privileged, right? But it might not apply to everything they're asking?

The request is so broad it seems like it must encompass at least something that's actually discoverable, although I can't think of anything off hand.
