Has anyone addressed the following possibility:

Ron Soye came to believe that Monica had been intimate with Vic in the past and this caused him to become jealous and consider breaking off the engagement.

Monica panicked and told a heap of lies about Vic forcing himself on her, so that Soye would still marry her ever expanding arse, and the two of them have been gung ho for Vic, ever since?
I've considered this for a while, Soye Boye is definitely getting cucked and Vic was most likely the bull, I think Vic's betrayal at the hands of Funimation was a collaboration of Monica's Thotdom, Soye's pettiness, and the other voice actors seeing an opportunity to get rid of a rival voice actor.

Based on his posts, the guy seems like a typical anime fan who landed a "dream job." Besides drinking soup in a questionable method,

As for Mignogna, the only thing about him that he posted on his social media was about how much he enjoyed Vic's rendition of One Piece's "We Are" (https://archive.fo/6o5Zj). He said this just days before Weeb Wars officially started.
 
She's "just" an executive director of what is essentially the HR department of Sony (or "Executive Director, Employeer Relations - People & Organization" as they call it).
My read is she's effectively a corporate trouble-shooter that gets assigned to remove employee based problems.

From a layman's perspective, it seems to me that Funimation's tweet implied or insinuated that their investigation substantiated the allegation against Vic.
Now, Funimation claims that's not the case, but whether a reasonable person would get that impression should be a jury's decision to make, shouldn't it?

Without producing said investigation, they shouldn't be able to claim the truth as defense either, right?
The fact that they didn't include it seems so ill-advised on their part, one might suspect they've got something to hide on this matter.

Assuming BHBH are going to require some limited discovery to beat this motion, how much leeway is the court likely going to give them in terms of "good cause"?
Could the limited discovery be applied to the documents MoRonica have, so far, failed to produce, if there's reason to believe said documents could implicate Funimation?
 
Surely there is an email running it by legal, just to make they meet the terms to break the contract right? I can't imagine not running it by in house council. But that seems likely, especially if no written notice was given which is something the lawyer would have mentioned.

I think they should request it in discovery. It's clearly related to the TCPA and relevant to it. Not existing would be embarrassing. It would really make it hard to establish they did anything like due diligence or had a reasonable basis for believing the allegations about Vic to be true.

You might even say the lack of such a report, or an incredibly inferior report, would itself be evidence of actual malice.

Sorry if I'm a little behind, but TCPA says discovery until its ruled on, right? If so, Vic wouldn't be able to get at any further evidence to help overcome the TCPA before its ruled on.

He's only working with whatever evidence he started the suit with until the motion is ruled on. And if the TCPA succeeds, there will be no discovery. Is this basically correct?

Ty can move for additional discovery, relevant to the TCPA hearing. Whether or not a judge grants that is to be seen.

That's how it would normally go, but I'm fairly certain that with the way Funimation's TCPA is written, they're the only party benefitting if the TCPA is successful. Other defendants will have to file their own in order to dismiss it and not have to provide discovery. Which, if we're being honest, is what all of the defendants should've done in the first place if they truly believe it's a SLAPP worthy suit.

A successful TCPA, not a sure thing by any means, would get Funimation out of the suit, but it doesn't make them immune to discovery. If the other lawsuits continue onward (which is probably guaranteed in at least Moronica's case), Funimation could still be subject to discovery requests regarding things like their investigation. And if continued discovery shows that they are indeed guilty of the initial claims Vic brought against them (and/or more), they can get dragged back into the suit afterwards.
 
@RodgerDodger\Anominous, quick question if you have a sec. How common it is for a lawyer to be brought a TCPA \ SLAPP \ Defamation lawsuit as a practicing attorney? Is it a once a year thing or even less frequent? With all the Twitter lawyers having such divergent opinions on how this case is "supposed" to go when they dog pile on Nick, I was curious how much of this stuff they're pulling out of their ass versus facts they might have learned litigating the actual issues in court. Thanks for any feedback as always.
