Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

Has anyone addressed the following possibility:

Ron Soye came to believe that Monica had been intimate with Vic in the past and this caused him to become jealous and consider breaking off the engagement.

Monica panicked and told a heap of lies about Vic forcing himself on her, so that Soye would still marry her ever expanding arse, and the two of them have been gung ho for Vic, ever since?

Soye watches Monica get plowed by Drexel and Q on a daily basis in his cuck cage; why would he be jealous of Vic pounding her mountain-sized ass?

Huh, so by implication "legal right" is a narrower subset of rights provided for by contract.
Not quite. Contract is a part of it. But it's any right that the law enforces. The law in the US does not (generally) enforce your right to free speech. The First Amendment merely says the government won't infringe upon it, but it's silent on other entities silencing you. However, in the areas where government does enforce your right to free speech, you then can be said to have a legal right to free speech.

It's not a narrower set of rights, it's just a different set.

And sorry, I do not have a case law on this. This is just a general definition.
TBH excluding natural/constitutional rights from the definition of "legal right" sounds like a really odd test.
If there was no distinction between legal rights and natural rights, things like NDAs could not exist. Or conversely we'd be saying that all your rights stem from government and you are going to get from government what government feels like giving you and you'll be grateful for it.

The Kameha Con contracts are somewhere on the site, so for at least that con we know what provisions they breached. They threatened breach of contract to get the con to breach contract with Vic. And failing that they breached their contract twice, once by backing out of the con and again by hosting the signing event close by. But it seems like Kameha con is letting that slide, as lawsuits are expensive and they don't want the trouble.
My understanding is KamehaCon worked that out with Rial to allow the signing event provided she gave free signatures to con attendees, which was basically saying "Sure, go exile yourself to a comic shop for the weekend and make no money."

Also, it's affidavits of other people saying they witnessed vic harassing other women. Not first hand accounts, and lacks any context behind the alleged acts. We've already seen people construe consensual acts as harassment.

They should depose the guy who accused Vic of stealing their sandwich. #believeallvictims

He's really butthurt about how fat he is.

Someone should start a gofundme to get him a treadmill and some slimfast to cheer him up.

Image is much more important to these people
As blatantly absurd as it sounds, it's actually true: this is exactly why Soye is willing to go a million dollars into debt (on legal fees alone) by hiring 3 different attorney firms rather than settling for an apology and sworn claim they were acting on Ruination's agency - which Ty would take in a heartbeat since Funi is the only one who can afford damages anyway.

The most insane part is that Soye is not trying to save face with the public at large, he's actually trying to save face towards Monica, the same person he made up all these allegations with and both know exactly how wrong they are. Imagine being so hopelessly narcissistic that you're white-knighting and gambling your entire future finacial stability for the sake of a person that you know intimately well how wrong they are because you helped them do everything you're both being charged with!

Add to that the fact that you're definitely losing the gamble even if you win and that Monica is just gonna drop you dead for the first sucker with money comes along, since you'll be high and dry even before the lawsuit is over!

That's not even an isolated example. Isn't there a figure whose brother is a convicted pedophile or something and yet they're trying to pin the pedophilia charge on Vic instead, with absolute zero evidence or even hint of that being true? These losers are the poster-people for narcissism and it's endlessly amusing to see MoRonica burn at the stake for the sins of their people.

Get woke = Go broke!

I've been re-thinking the Nick subpoena tactic, and I think maybe there is a different plan behind it.

Remember that they were arguing about a confidentiality order shortly before the notice was filed. In the list of documents they want Nick to produce, #3 is requesting:

"Documents between or among you and/or Mignogna and/or BHBH and/or the Mignogna Witnesses concerning the Defendants, the Petition, any allegations in the Petition, and/or the GFM" (emphasis added).

The other 3 requests are specifically about communications with Vic about the GFM and how it's spent; but here they want everything BHBH has told Nick about the defendants or the case.

I think MoRonica is trying to prove that BHBH is leaking info to Nick, specifically about the allegations and stories against Vic. Three months ago, I would have said they wanted this to prove Nick/Ty was being "unethical", so they can file yet another failed ethics complaint. But now I think they want to prove that BHBH is "dangerous" leaky and can't be trusted with sensitive information, like the names in the affidavits or the Funimation investigations.

They might be hoping to shame Ty in front of the judge, so they can get a court-mandated confidentiality order after they previously botched the attempt to get one. They know how dumb they look making the argument on their own concern, after their pre-deposition arguments against one. So they want the court to come to that conclusion on its own, and issue a gag order in light of what they find in Nick's communications.

TL;DR the subpoena to Nick might just be gay ops to get at Ty Beard's text messages.
There’s no different plan to it other than to try and get paid by defendants that can’t pay you at all

There is no communication and they can rack up their billable hours all they want to get an on the record statement that says the same

The depo can be conducted at a court house, just like Vic, Ron, and Monica were. This was just a notice, it could easily have gone through official channels, instead they doxxed an old address and sent it there. As for the affidavits, perhaps they have some info in them, but we only have rumours about them, and until cross examined, they are not evidence. Generally Affidavits are used to supplement evidence, as they are in the end just someones point of view. They can help make a case stronger, but without a solid base don't add much. And if rumors are believed, they are stories we already know, which are about as far from "sexual predator" as the sun is to Earth.
Depo can be conducted at a court house, though I'm not sure if it works like that for out of state depos. There's some complexity there I haven't dove into yet.

Affidavits, while not 100% perfect evidence, are still fairly persuasive in most courts. I think if you look at a lot of rape cases, they essentially come down to he-said/she-said, and one way or the other you're relying on witness testimony.

In this case, Ron and Monica are planning to file a TCPA motion to dismiss. They will probably attach (like Funimation did) sworn affidavits that supports the truthfulness of their statements. If Vic can't impeach the credibility of those statements, Vic loses. If Vic can't produce clear and specific evidence that Ron and Monica knew that the statements were false when they were making them, Vic loses.

We also have those texts Ron Toye sent to the head of Kameha con to blackmail them dropping Vic by holding his company's donation hostage, and claiming Vic was in a criminal investigation, which has not happened. Shane was even nice enough to get the texts from Ron to authenticate them, so we know they are real (top tier plays, proving your TI). We also have reason to believe that other cons got the same spiel because those texts mention Monica's agent talking to them. Which is why Vic's side would like them to hand over their discovery instead of playing stupid games dodging it, and trying to bring in more discovery for their side when they have not even produced theirs.
Here's the KC texts I could find:

Assuming those are the same ones you have in mind, here's what I see:

- Ron is offering to sponsor/purchase a booth at KC, but no contract has yet been signed.
- Chris says that if his victims comes forward, based "on our contracts", Vic will be dropped. That reads to me like the contract has a provision that allows them to drop guests for "probable conduct or legal isssues". If true, this is not a contract breach.
- Ron says there is an "Sony investigation" going on, and a "legal investigation" taking place. It's not clear what "legal" means in this context, it could mean civil, criminal, or just "conducted by a law firm"
- Ron claims other shows have dropped him.

In order to prove TI, we do need to know what specific contract terms were breached. I don't see anything here that looks like a breach yet.

He's angry and furious that he's a cuck to a gaylord in mariachi pants who was the only dude who could get his fat slut of a wife, oh, wait, I mean fiancee, because that marriage is totally going to happen Ron, an orgasm, something he's never done.

If Vic's contract had an exception allowing for contract breach in case of "probable conduct or legal issues" or something along those lines, would fiscal pressure on KC from a third party to exercise that exception count as TI? I imagine it would but am unfamiliar with the relevant TX case law.

Yes. Even if a contract allows it to be terminated by either party at will, it's still TI. And yes, this is Texas-specific.

This makes lawtwatter's reaction to the soye texts even more confusing. It's such blatant racketeering, he offered a hefty fiscal sponsorship, then said it's not gonna happen if vic is attending. the quid pro quo is in the fucking text thread. how can anyone see that as anything else?

Nick Rekieta has spent a lot of time explaining why these common laws that you are writing about here do not apply. Basically, because it’s Texas. If this had happened in almost any other state, Vic would not have the case that he does. Have you watched Nick’s streams? There are a lot of them, but he provides the in-depth legal analysis it sounds like you’re looking for (if you are engaging in good faith).

Nick is running the GFM, right? He is therefore far more qualified than anyone else to offer input about the financial aspects.
It’s a GFM, there is no information available to Nick other than what EVERYONE already sees publicly, there is literally a public list, you want more? Subpoena GFM. This isn’t a fucking eBay sale that links to checking account nick can see every payment from, don’t be exceptional.

A) Because the depo can't be conducted at a PO box?
B) I don't know about that. My understanding is that there's been some sworn affidavits provided to Ron and Monica's defence from other people that have witnessed Vic harassing women. Unless Vic has specific and clear evidence contravening those affidavits, his suit is DOA.

Do we know what the specific contracts were and which provisions were allegedly breached? Do we have the entire contract? I don't like forming a solid opinion on incomplete information, and I have more questions than data right now. My understanding is that there needs to be a specific contract term that was breached.

A) this is a notice of intent, again don’t be exceptional
B) they haven’t “witnessed” Vic do anything, they are quite literally “I heard from so and so that Vic did so and so” you’ll see that when they’re public and why they wanted their names retracted so badly

Don’t lie to yourself you’ve quite literally already formed an opinion and are trying to change people’s minds not actually get your questions answered

Depos would be conducted at nicks convenience as he’s a 3rd party unless they can convince a Minnesota official otherwise

The key word to what you said about affidavits is WITNESS, it’s only a strong admissible affidavit if it’s eyewitness/ first hand accounts... this is TEXAS buddy.

Vic and his attorneys (as well as most people on the farms) have already destroyed any stretch of the imagination the “evidence” that Monica and Ron have don’t push your luck on what Twitter law has told about that being wrong.

Your understanding of TI is what twitter law has told you, do you understand fully and clearly what TI Vic is actually suing for? because you seem to have missed the part where Ron is leveraging Extortion on a sponsorship front

Even the Denbow affidavit has her telling them things to do relating to the "investigation" and what, that was just a polite request? They were acting independently after that?
From what I know, Denbow was in a position to tell Funimation whether Vic would need to be fired or not. She could make the final call on it. Making the call was most likely part of her job. Honestly, if she isn't involved in the whole thing, it would surprise me, because nothing points to Funimation being independent from Sony.

They don't, they're just scummy whores enough they're willing to say whatever is on the right side of wokeness and completely ignore any and all facts to the contrary. Look at all the idiots who thought Oberlin was on a clear path to victory.

I don't think she was in any such position. I think they called her in to give legitimacy to some bullshit they'd already decided to do, and they even cut her "investigation" short when it wasn't panning out. She wasn't the one who made the call here.

I'd like to know who was.

Also just in general for Denbow information, check her out in the WikiLeaks dump from the Sony hack.

i keep forgetting that this faggots find the social thrill of internet points is enough incentive to be worth lying. how embarrassing.

I find the conduct of the lawltwatter to be utterly baffling. It's somewhat excusable to mouth off on a potential case you came across in passing, because there's a good possibility it will never see a court due to the expense of bringing it. But, Good Lord, this stuff is in front of a judge. There are going to be rulings. Why on Earth would you make declarative statements about a case you are proudly ignorant of and go out of your way to be utterly disdainful of the other side? You're just setting yourself up to be shown a fool. WHYYYYYYYY????

(And yes, that is a rhetorical question. Internet backpats are the opium of the exceptional.)
