"Not yet" is the only answer he could give. A negative response but gives the appearance there is hope. That the judge is in fact competent and working on it now.

His audience has no idea how court works, let alone the appeals court. If he suggested Chief Justice Roberts woukd personally cancel the appeal, they would believe him. So those idiots will believe that the defense can grant such a thing.

As far as I can tell, the appeals court puts you in the queue and only talks to you once. There isn't going to be some hearing for an extension like the lower court.
