Could Ty raise the discovery abuse as a reason for the judge to deny these requests?

Could he? Yes. It wouldn't suffice on it's own, but it could increase the weight of other arguments. However, it's probably best not to unless he wants to lose the most effective way to use it. If you repeat the same complaint as an argument for different things it kinda seems petty, and generally it's not good to look petty.

Mignogna v. Funimation says nothing posted in the last two pages is defamation. So J. Sean Lemoine (who I hear raped and murdered a young girl in 1990 before being struck down by God's punishment West Nile) is shit out of luck.
 
Maybe that's his strategy: If you can't win at TCPA, just wait until you get an inexperienced judge and make your OWN precedent.

The hope is to find out what was said and by whom. This is one where they aren't going after the GoFundMe directly, they're lookign to find out what was said, who said it, and because I think they realize they're probably boned when the TCPA is appealed, they want to try to shut Chuck Huber and Chris Slatosch down. They want to pretty much guilt them into retracting their affidavits/unsworn declarations, ignoring that there's a good case for witness intimidation at that point.

Nick has already said that he's not waving privilege, so Ty isn't going to provide any information or correspondence from Nick, especially since Lemoine filed their motion to file a subpoena against Nick and thus making him, ostensibly, opposing counsel in a possible lawsuit (since Ron has mentioned suing Nick directly multiple times).
 
Why don't these lawyers just come here and discuss this case without randomly picking and choosing posts? It's not like they'll be doxxed just because they showed up, and some of them have already been doxxed so they have nothing to lose. Not all of us are lawyers, not all of us are American, so currently my only window into the Texan legal system is through members of the Farms, and I'd like to see other viewpoints, because otherwise you're just in an echochamber.
Egos my man. Having met a number of lawyers irl, they have some of the biggest and most fragile egos you will ever meet. Imagine coming here and getting ratio'd to hell by KF regulars. That would be too much for them.

i really hate to be a conspiracy type, or see malfeasance where sim0le incompetence would explain it. But the student of human nature in me start to wonder what was in that extra special Ex parte binder Lemoine delivered to Chupp. And how many zero’s were in it? I’m not saying Lemoine bribed the Judge, I’m just saying the pattern of observable behavior and gross yet deliberate misapplication of the law, plus these strange leaps into bizarre territory make me wonder how much Lemoine paid to bribe the Judge?

And Chupp seems to have a record of not listening to arguments from plantiff's and expecting the appeals court to tell him what cases he should look at.

I mean, there is incompetence, then there is "I'll look the other way to when this goes down" as appears in the TCPA hearing.
I wish the appeals court would force Chupp to pay the attorney's cost in all the cases where his negligeance caused an appeal. I feel that this shouldn't happen, or if it happens, the reasons why pays the bills. It's unreasonable to not do his one job, ask the appelate court to do it for hin, and ask all parties to accrue more cost because of his negligeance.

It'd make Nick a potential witness or a potential defendant, but it wouldn't make him opposing counsel (unless he decided to represent himself, which he wouldn't do).

No. The only thing that can restart that discovery would be if Vic wins his appeal, which would revive the lawsuit.

As far as the lawsuit is concerned right now, there is no reason for the defendants to comply with the original discovery because the lawsuit was entirely frivolous and has been dismissed. Vic's appeal can reverse that, but until and unless it does, that's the situation.
