I'm wondering if after the Judge does the most basic elements of his job, he might undo some of his dismissals. Is that an option? "Upon further review the TI is back on the table."

Well, the lawyer has to do his job before the judge does. Answer the "show me why the court should be resolving this dispute at all" question to the judge's satisfaction.

He might reverse it later, or he might be just as happy to have both of them out of his courtroom

See I've been on the fence about appeals. Vic and his team need to be able to conduct discovery and the time between the end of this case and the start of a new one could potentially mean that things get "lost" along the way. And the opposition is underhanded enough to do some sus shit in order to sweep their responsibility under the rug.

If they're even allowed to do more discovery or at least get subpoenas to get what they need.

I'm just hoping they can move forward with a clean-ish slate and I'm not sure if another go with Chupp would give them a better chance or appeals.

Thing is, and I've said this before but I'll say it here too, now all parties know what they're dealing with in Chupp. Before they've had very limited interaction with him and now they've had a full hearing with him, they have the best read they're going to get. He makes decisions quickly, he's decisive. If it doesn't make sense to him, he thinks it's bullshit and there's no convincing him at that time.

So, moving forward it's better to adjust your approach than it would be to risk trying to get a new judge and going through a new set of quirks, AND have the perception that you're just babyraging over a Judge's decision.

Better to rise to the Judge's expectations that he's now showing are exceptionally higher than standard, and cover your ass in every hearing with him to make a good case for appeals if it swerves out badly (this goes for both sides btw).
 
Time will tell if anything gets appealed, or if it's even a smart thing TO appeal.
I'll assume if Chupp doesn't throw out defamation and civil conspiracy that Ty just takes his licks, realizes he fucked up, and proceed with those causes of action.

TI was for the money. Defamation is for Vic's reputation.

And I just know if discovery moves forward, it'll be scrumptious.

Good Lord. 1200 pages, mostly already filed elsewhere, with days to go to the hearing was a terrible approach. If anything was going to make a judge not read the filings, it's opening up a document to 1 of 1200 in the status bar

The vast majority of that was just the full depositions. If he'd been prepared with a tabbed list of the contents he might have even been able to cite more evidence instead of getting flustered by Chuppers.

So to those more versed in TCPA or just generally informed on the matter:

Was Ty supposed to be able to produce new information at the hearing? Nick's comment about "no response even needs to be filed for TCPA, they still have oral arguments" came across as meaning new information could still be introduced.

That specific line contributed to my surprise about the 2nd amended pleading being thrown out.

That won't be resolved by this court. That gets resolved by exposing that the accusers are lying scumbags.

If all you're concerned about is Vic's innocence, don't bother following this case, because you're expecting the court to remedy something it absolutely has no jurisdiction over.

Attached below is a visual spreadsheet of all the 2019 judicial reference scores for civil judges in Texas, Chupp included, based on various criteria. I'm not too sure as to who submitted the scores for the evaluations, but it's likely a mixture of lawyers and associated court personnel who have worked with the judge in question on trials. While the original document this spreadsheet was based on was posted a few days ago, its format is honestly pretty shit for getting any sort of meaningful data for just one judge, let alone comparing them, so I reformatted it into something actually serviceable.

If their reactions haven't telegraphed things so far, even if the defamation charges stick through trial and appeals, the KV side are going to galaxy brain some explanation for why it doesn't prove anything.

These people already refuse to operate within the realm of facts, truth and logic. What makes you think a court is going to change their thought process?
 
Don't know why people are bothered by the public figure thing, Vic was always incredibly likely to be found as such. Yeah, he ain't no George Clooney or Brad Pitt level of known, but he is known enough that people all over the world are talking to people on the other side of the world about him, even before all this went down.

That's not exactly true. Even many anime fans don't watch anime in english dubbing.
Even fewer of them are interested in what the actors' names are.

It has nothing to do with changing their opinions more discouraging them from repeating the defamation through fear of them being on the chopping block next if they don't stop.
