Because even his demented soup-brain knew that you could just act like they don't exist, and nobody would care.

As a result, either Trump and his admin are so unbelievably incompetent that they cannot stop shining a massive spotlight on the thing that has repeatedly caused nothing but problems for them, or they know how bad it looks but they need to try to cover it up anyways. Regardless, they pushed the envelope too hard, and I really doubt that trying to memory hole it is an option anymore. People want something, and if they don't get it, they're going to continue believing that the admin is in on it.

The language seems pretty clear. It only counts "persons", so it shouldn't be too hard to argue against counting illegals.

Also interesting that it specifically excludes a subgroup that didn't pay taxes. Almost like there was some intent there.

Article I, Section 2, Clause 3:

Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct. The Number of Representatives shall not exceed one for every thirty Thousand, but each State shall have at Least one Representative;

The Constitution doesn't say that you have to count every illegal immigrant, it says every free person. Illegal immigrants being counted in the census varies from state to state because it's a voluntary act. If you're an illegal immigrant living in lets say Illinois, California or Colorado then you don't mind filling out the census because identifying as an illegal immigrant is low risk(sanctuary state) and the blue state appreciates getting more seats.

If you're an illegal living in states like Alabama, Florida and Utah you might not fill out the census form because they might use census data for ICE immigration enforcement so those states don't benefit from illegal immigration.

This has needed to go to the supreme court for a while. The term "free persons" at the time of writing was understood as a person who was a non-slave nor an American Indian but today that's anyone not in chains. The term "free persons" needs to be updated to citizen/citizens.
