Law Teacher presses charges against 8-year old autist - He tard rages, she gets punched. Now they may go to court.

An autistic 8-year-old boy is facing a battery charge after his special education teacher filed a police report after he punched her, according to reports.

Police said the student hit the teacher in the face when she tried to take an iPad away from him, according to KRQE.

“I was not made aware that a police report had been filed against D.J.," the boy’s mother Maria McKay told KRQE. "Very shocking. Definitely was not prepared for a missed phone call from juvenile probation that my 8-year-old autistic child had failed to appear for a scheduled meeting. I called back and assured him there was a mistake.”

Turns out it was not an error.

"There was an incident in early March where a 2nd-grade student punched a staff member,” school officials said in a statement. “We cannot speak to student or personnel matters, but I can say that the school did not initiate the police report. In addition, we cannot prevent a staff member from personally filing a report. That is his or her right."

McKay said her son’s actions were not right but thinks the teacher should have handled the situation better.

"When he is in an environment that's really loud he starts wailing hands and he has hit in the past,” she said. “We've talked about it's not OK to hit people and we need to come up with ways to better communicate with each other because hitting is not OK. He does understand that after the fact but he doesn't understand that in that situation.”

Her son did not go to school last week and likely will stay out of the classroom as his case navigates the legal system, according to KRQE.

“I just felt this is not an environment that my son should return to,” McKay said. “He now has to appear at juvenile probation next week for an appointment. He is absolutely terrified.”

Mom says that the teacher should've expected to get hit and her poor autistic son is being misunderstood. Weaponized autism is a dangerous thing.

I worked at a school with a huge special day program (new fangled term for special ed) where the teacher was knocked out by a flying chair. Knocked the fuck out, had to call an ambulance, police called.... whole nine yards. A teacher getting punched by one of the autistic kids is an every day thing, it isn't court worthy.

UNLESS!!!- the child is known to be a danger to themselves or others and has multiple other assaults under their belt, with the school/parent doing nothing to help the teacher deal with the problem student. If the student has attacked this teacher before repeatedly, and appears to be targeting them, yeah. Call the cops if the district won't listen. But since this article doesn't mention it, I am guessing that she got hit and realized maybe her dreams of healing the tards wasn't realistic, and wants the hell out of that classroom, and her contract won't let her.

Then he doesn't belong in a mainstream school and it's not fair to faculty and other students to place him in one. I'm guessing this was just a special ed class at a regular school and not tard school. At least they didn't try to stick him with normal students.

Sure, he's only 8 right now. But what's going to happen when he's a 200 lb screeching teenage autist hurling desks across the room because the teacher won't let him watch Lego videos during class?

I think it's stupid to sue. I could understand if the kid was a teen and dangerously large. But an 8 year old isn't a huge threat to an adult. The kid isn't going to understand what's happening to him. His overly permissive mother making up excuses as to why we need to let her autistic kid off the hook is probably the real problem. I guarantee she makes excuses all the time and lets him run screaming through stores and have whatever he wants at home.

Back in my day, tard classes always had a giant nigga (usually with barely any qualifications to work in education) employed as some kind of 'teacher's assistant' whose sole job was to pry a violent tard off of the actual special ed teachers if they went into a violent tard-rage.

I think this is a widespread practice, but in underfunded schools I imagine the tard/giant nigga ratio isn' too great. He was probably off keeping an eye on a kid with a worse reputation for tard rage.

Sure he's 8 and can't break bones etc. He may grab a pencil etc... But if someone is having outbursts over and over and your boss says suck it up to the point you need legal intervention it's insane.

They "teacher" was most likely a behavioral technician, who are in such short supply yet high demand in NM because of all the room temperature IQ mental deficients this state has as a result of rampant contamination of local water supplies from abandoned mining operations.

My guess is the kid in question should not have been in a regular school in the first place. I've had to restrain autistic children (and I'm not a particularly musclebound person) and it does get a lot harder once they get to 7+, most kids around the age of eight these days are nearly as tall as I am. Most mainstream schools don't allow the use of physical force so restraining him was likely not an option, which really only leaves calling the police as a last ditch effort to show how out of control this kid was. You can't just shove a regular edition special ed teacher trained to work with Down's Syndrome and the learning disabled at a kid who throws violent tantrums when she's not even allowed to physically restrain him.

Our man had to pull double duty as one of the computer lab babysitters when tard classes weren’t going on, thanks to staff budget problems.

I don’t know where Mr. Crane is now but hopefully he’s still got tards to pummel and shitty mid-90s Macs to reboot.

Regardless of whether or not this teacher is pulling a bitch move, a lawsuit like this could scare parents into actually parenting their tards instead of tossing them at public schools and expecting the teachers to deal with the little shits’ behavioral issues.
