This is a very interesting filing.
I particularly found this part to be interesting.


Basically Destiny's lawyers didn't object for an order to compel Lolcow LLC until Pxie's lawyers asked for fees. Or at least that is basically what they said in this filing.

I don't know if it is a good idea to say well I basically agree to everything but this one part when we conferred but now I don't agree at all. It looks very two-faced. On the other hand I have no idea if not including the fees portion looks bad by Pxie's lawyers or if it is normal.

Briefly touching on fees. I have no idea if Pxie is asking for too much when she asks for fees. This is what Pxie's lawyers argued in her motion as to why they should be granted fees. The thing it references is just the Revenge Pornography law provisions that a victim may be awarded appropriate fees. But most of that part of the law looks like it is talking about the final judgement.

Basically the theory behind why she should be awarded fees is that Destiny has not acted to have the videos taken down forcing Pxie to pay to have it done.

This is a reasonable argument in my opinion. If Pxie does have to pay to have this stuff taken down then that is money she can't spend on the rest of the lawsuit. Destiny is the one who allowed these videos to be leaked. It is fair to ask him to bear the monetary burden of having these videos taken down.

But I have no idea if Pxie can get fees for this or if that part of the law only applies to after the lawsuit is concluded. It doesn't help that this law is new. If I had to guess I might say that she will not be granted fees. But I am like 55 won't 45 will because I just have no idea what the legal precedent for this is.

Yes, he wants to inflict the maximum amount of pain and stress on her for filling a lawsuit in the first place.

Could be that Destiny's lawyers are the one being duplicitous and agreed but found the opportunity to oppose this to make the lawsuit more expensive and difficult for Pxie. After all he could have done the same exact thing as Pxie and it would even be a reasonable defense in court.

I understand their argument, but Pxie's lawyer explicitly brought up legal fees during the meet-and-confer. It's right there in the e-mail exchange he filed: "If your client would like to reimburse the Plaintiff for the legal fees she has incurred to date regarding the removal of the Video from Kiwi Farms, we would consider including the links to the videos of him in the proposed order." I guess I could see it coming across as duplicitous that she didn't include it in the draft motion she sent him, or that she did not explicitly say she was going to request the court to order attorney's fees, but for him to claim that he was "sandbagged" and that she never raised the issue seems a bit rich when she explicitly raised the issue in that email. And he didn't file his response to that email, but I suspect he declined to give them attorney's fees. The whole point of requiring a meet and confer is to see if the parties can resolve disputes without court involvement. If he wouldn't agree to reimburse attorney's fees in response to that request, of course he'd oppose any motion for attorney's fees. Asking the court to deny the motion for failing to meet and confer on a request that they already denied in correspondence rings a bit hollow to me, but I guess we'll see what the court says.
