War South Dakota Bill Aims to Nullify Joe Biden’s Executive Orders - “Lol Sanctuary State”

I can’t say I’m a fan of half the country ignoring whatever President is in power going forward, but democrats sowed this seed with how they governed California.



“Legislation introduced in the South Dakota House of Representatives seeks to give the state’s attorney general the authority to review executive orders from President Joe Biden and potentially nullify any order deemed unconstitutional.

State Rep. Aaron Aylward (R-Harrisburg) introduced HB 1194, which is described as an act “to authorize the review of certain executive orders issued by the President of the United States.”


The process to potentially nullify an executive order, which by nature bypasses congressional approval, “begins with a review by the Executive Council of the Legislative Research Board, followed by a referral from the Council to the attorney general and the governor,” South Dakota news station KELO-TV reported last week. “Once the referral has been made, the attorney general may examine the order to determine whether the state can seek an exemption or declare it unconstitutional.”

The bill specifies that Attorney General Jason Ravnsborg could exempt South Dakota from any law or order “that restricts a person’s rights or that is determined … to be unconstitutional” if the law or order relates to the following:

  1. A pandemic or other public health emergency
  2. The regulation of natural resources
  3. The regulation of the agricultural industry
  4. The regulation of land use
  5. The regulation of the financial sector through the imposition of environmental, social, or governance standards, or
  6. The regulation of the constitutional right to keep and bear arms”

I was cool when the left did it and I'm cool when the right does it. Even lefty issues rely on states ignoring the federal government. Weed laws, gay marriage, abortion, civil rights, search and seizures, imprisonment, etc. All of it comes down to state's defying federal orders until the position is popular and politically safe enough to happen on a federal scale. Hence why we are a republic and not a democracy.

@Hollywood Hulk Hogan Let's say I'm hanging outside of an abortion clinic and see a woman that's clearly pregnant and going inside. If I throw her off the ropes and give her the big boot right to her uterus, should I be charged with murder or practicing medicine without a license?
 
This is going to go nowhere. Congress can revoke an executive order and even if that attempt reached there, the Democrat majority will reject it. Courts can do it too but I doubt cancelling a construction project would be considered unconstitutional.

It's almost like someone doesn't want to talk about the contents of the 28 EOs biden's made in the first fucking month of his presidency but that sounds like trumpist logic.

In fairness, that was due to HHH deciding to bitch about states being allowed to decide their own abortion laws. Everything went downhill after that.
 
Interesting how the Supremacy Clause is becoming increasingly subverted by both left and right wing interests. Also interesting (read: disappointing) how few people seem to know the Supremacy Clause is a thing in threads like these...
