Should AI-generated CP be illegal?

Since the Fishtank thread on /tv/ is being spammed with it the question arose.

The obvious answer seems like Yes because it's nasty but at the same time it doesn't seem as obvious to me when I sit & actually consider it. The whole point of outlawing CP is to protect real children from abuse. If an AI generates a pornographic image based off 3D models or medical textbooks then a real child wasn't & isn't being harmed. It's effectively a more realistic-looking lolicon drawing.

Yes it should be illegal, but we also need to rethink our ideas about collective speech. I highly recommend Robert Bork's Skouching Towards Gomorrah, esp the introduction which discusses the phenomenon of Defining Deviancy Down. In short, the slippery slope fallacy is no fallacy at all.

In theory, we could make porn in general illegal and looked down upon, and spare ourselves this constant threading of the needle we're left doing about these specific edge cases (others include-- or should include-- depictions of crime such as rape, battery, murder, cannibalism, et cetera). Absent that-- I should delineate between my two sensibilities.

Conventionally speaking, I find the idea revolting and far too close to actual CP in its "perfected" form. It's bad enough that it's porn-- it absolutely cannot serve any good to a society that already hates children. Accordingly, it should be illegal.

Technically speaking, CP is illegal entirely because it's child sexual abuse in photographic or videographic form-- that it is not strictly about one's visceral sense of revulsion needs to be understood and accepted.

As it stands, what's illegal (in the States) is drawing or otherwise producing sexual depictions of real children that exist in real life. I can't envision that the training set that such an image generator would use, could or would be reasonably moderated to exclude photos and other depictions of real children, and there's no way to guarantee that it won't produce-- say-- a face or torso sufficiently identical to that of a real child in that training set. The inherent risk of this is too great, even in our current societal paradigm, to do without risking the victimization of children.

Accordingly, it should be illegal.

Depending on what someone has fed their model, the person making prompts could be adding in phrases like 'small breasts' simply as mollification against the ai constantly trying to generate J-cups. I can imagine someone accidentally generating something which technically qualifies as CP, and in that circumstance the responsible thing to do is delete it straight away, then seriously reconsider your prompts and what the hell you're really trying to make in the first place.

How is it harming children if no children are being harmed? That's like saying using the nigger-word online is violence against black people.

Just to be clear does that mean we should ban drawings as well?

I accuse you of wanting to fuck children. As we are a society who punishes off pretense alone there will be no investigation into my claim. Let me know how heaven is (I won't be going there as I am an amoral psychopath who uses the law to kill people she hates.)
