If you can't get a grand jury to indict it's an absolute waste of time to even bother prosecuting the case. The fact is that the police broke no criminal laws, and the fact that people will chimp out and riot doesn't mean you get to prosecute innocent officers.

I assume pure incompetence from the person who wrote the factual basis for the charges. It's either that or they're intentionally trying to sabotage the prosecution, but I think incompetence is more likely.

It's still the cowardly, wrong decision. I would not actually be surprised if the prosecutor is deliberately undercutting his own case because he knows how absolutely bullshit this is, but he's still putting an innocent man to the expense of a defense of lawful conduct.
