That threw me off as well. Everything I'd read up until this point said "up to 10 years" if prison is involved with that particular conviction and no others. Double checked VA penal code thinking maybe they just generalized but again with Class 5 Felony (which it would fall under,) it's "up to 10 years." I thought maybe whoever wrote it, through oversight, referred to NY penal code instead (given it's the Post) but that number doesn't correspond with NYS incest charges (which are somewhat different from VA but in all cases, for speculative purposes, didn't match. Not sure where the hell this number came from.

It could be something as simple as Chris identified himself as female and until they did a full body inspection/cavity search/intake/whatever, they took him at his word. Once they saw that he hasn't had GRS, they changed it.
