That's an idealistic view of it. Overstay a visa and get picked up and it's entirely common to get deported before even getting to make your case. Sure, you get to make it back from your home country, but you've still been deported. You also have to know you have those rights to exercise them. There isn't a "Miranda warning" before deporting you, informing you you can challenge it. In fact, sometimes, the people administering deportations outright lie to people about their rights.

I think the forker here just crossed one of those invisible lines by a collection of actions that smell bad when seen as a whole.
He forked, stripped attribution and history [+] (license violation, but on its own probably just rises to the level of minor dickishness and is often a misunderstanding)
He started advertising his fork to replace the originally forked repo (a bit rude).
If the original library was unmaintained or unused, this probably would have been a big nothing-burger. But apparently the library that was quietly forked had a fairly big install base and contributing to that library first would have been a better choice.
What is missing from the discussion (and often unaccounted for in licenses themselves) is that there's a massive personal value to having a library used by large numbers of people.

I don't think it will push restrictive licensing. Seems like MIT is the de-facto license in JS land and you won't change that anytime soon. Licensing is a headache anyway and I wish it were simple. I still want to use AGPL for everything but I don't even know if and when I can.
To me it looks like a clear case of plagiarism, and the guy is getting knocked on the head and publicly dragged, which is what I would want in that case. I hope it will make others wary of working with him. It's a case study of blatant copying and weaseling caught right in the open, no matter how much drama or retardation are involved. Licensing won't help you here, he even violated the MIT license, originally.
