I'm going to be the UHM ACKTSHULLY guy.There are some serious entitlement issues and magical thinking issues among the upcoming generation of natives. Every time I hear the phrase "since time immemorial" I cringe as a reflex. Everyone knows natives have been in North America for a long time, there is no need to exaggerate it to infinity.
It just means "a time before we kept legal records." Specifically, to the britbongs that invented the phrase, it means "before 1189, at the end of King Henry II's reign."
It's a very finite legal term of art.
