Law Namibia's sodomy law declared unconstitutional

The criminalisation of sexual acts between men in Namibia was declared unconstitutional and invalid by the High Court in a landmark judgement on Friday.

The common law crimes of sodomy and “unnatural sexual offences” are unconstitutional and invalid, the court declared in a joint decision by judges Nate Ndauendapo, Shafimana Ueitele and Claudia Claasen.

The court’s judgement was given on an application by a gay Namibian man, Friedel Dausab, to have the common law criminalisation of male anal sex and “unnatural sexual offences” declared unconstitutional and invalid.

The court also declared that the inclusion of the crime of sodomy in sections of the Immigration Control Act and the Defence Act is unconstitutional and invalid.

The court stated in its judgement that the common law offences of sodomy and “unnatural sexual offences” differentiate between male and female persons and between gay men and heterosexual men.

This amounts to unfair discrimination and is unconstitutional, the court found.

The judges also stated that the view that homosexuality is “an abominable vice” is based on prejudice and personal aversion.

Ordinary people would often not be able to produce reasons for such views, but would simply parrot their neighbour’s views on the matter, the judges remarked.

Dausab alleged that the criminalisation of consensual sexual acts between men violates the fundamental rights and freedoms of gay men and men who choose to have sexual relations with men, and discriminates against people on the basis of sex and sexual orientation.

He said the crimes of sodomy and “unnatural sexual offences”, which are part of Namibian law though the country’s inherited common law, are a legacy of Namibia’s colonial history and have historically been aimed at stigmatising, punishing and excluding people who do not conform to the dominant heterosexual norm.

Dausab also said although people are rarely, if ever, still charged with committing sodomy or “unnatural sexual offences”, which he said is a vague term, these common law crimes continue to stigmatise and marginalise same-sex couples “by outlawing the most private and intimate expressions of their love and identity”.

Attorney general Festus Mbandeka opposed Dausab’s application on behalf of the government.

Mbandeka has said in an affidavit filed at the High Court that the public sentiment has not reached a point where the people of Namibia, through their elected representatives, have decided that it is time to repeal laws against homosexual conduct.

Mbandeka also argued that the Constitution’s article protecting equality and freedom from discrimination does not include sexual orientation as one of the grounds on which discrimination is prohibited.

Couldn't you have at least referenced the recent ones first? And also, you know that the aid the US sends is massive when compared to what an NGO sends, and that there were several lawmakers that put forward the idea of witholding aid to Uganda got its new law regarding this, at most, you can argue that both sides are influencing the africans
 
Yeah it's totally unnatural that some courts saw that a hundred year old colonial era law probably isn't constitutional but the millions of dollars being sent over from Christian megachurches totally has nothing to do with it.

The goverment itself wants to keep the law, I think that they would be able to ammend the constitution. Also, I really doubt that they just now, after like 30 years of namibian independence, realized that one of their laws went aganist their constitution completely on their own

I hope they do. Even if one supports the homos and all that, one must recognize that having a court just shutdown a pre-existing law out of the blue is no basis for a democratic goverment, in the same way that having a court create a law (like Roe V. Wade was) is. If you want separation of powers, you have to commit to it.

Sure, I think a lot of that is looking at current trends and public views on things. But a popular thing at the moment is "unlearning" a lot of views that were forced onto colonies by their colonial overlords, and for the last 50 or so years there has been a gradual repealing of those laws. It probably took a while for the anti-sodomy laws to go away because so many people in Africa are Christian and Muslim which both of course outlaw it. Anything religious like that will hold up the longest.

One that I found from the state department had a funding CEILING of $1,000,000, and I have trouble finding anything of out-of-country NGO's doing any pro-LGBT lobbying.

It is truly remarkable how many Constutions from the 19th century or earlier are, we are now discovering, incredibly amenable to the bum boys in spite of all previous understanding of the topic.

I don't understand what you're trying to say here. It's almost a given that colonies have to figure out what colonial laws were naturally brought on or were forced on them against their will. It's not the place of millionaires from the US or retards on a drama forum.

What I'm trying to say is that most cultures and civilizations don't like fags by default, and that due to this law still existing for this long and due to the way it was shutdown, it is safe to say that the namibians here still don't

I know it's Wikipedia but it's a well researched and annotated article on the views of homosexuality in the world. It shows that the only place where homosexuality was frowned upon was the middle east and possibly pre-Christian mainland Europe (although it could be that they just didn't do pederasty). And that pederasty was only really popular in the Mediterranean region.

They laid it out plainly at the end, the people of Namibia absolutely didn't ask for this and that country surely has a billion more important things to worry about than taking the first step toward embracing the religion of Globohomo. This is purely a top-down diktat issued from yet another globalist-puppeteered court to force one of the biggest tumors of modern progressive cancer down the throats of Namibians when they wouldn't even consider voting for it in any halfway fair election or referendum and I hope the Namibian people, being less domesticated than Westerners, will not only pay it no mind but also lynch any thug who tries to enforce it.
