If the person was unconscious and said they didn't consent to it, I'm not sure whether it would be rape or merely sexual assault - I'd have to brush up on criminal laws, but I believe that rape requires actual genital penetration, and if that isn't met it would be downgraded to some type of sexual assault or battery.

(Also some state laws don't actually use the word "rape" - they use a term like "aggravated sexual assault").
