I'm not sure about Barb's situation, but if she is unfit to care for herself a family member or social worker may have consented to it. Unfortunately, they'll only find DNA if Chris recently assaulted Barb. DNA is easily destroyed not only over time but with soap/water. They not only look for semen but also hairs or skin cells. They sometimes swab the suspected perpetrator's genitals as well. That's called a penile swab

Judging by the presiding courts involved in the cases, it looks like the only ones that involved the TRUE and HONEST Barbie-Chan were the Snyder incident, and her fender-bender late last year.

She could be charged if it was consensual. Prosecutors don't have to charge anyone for anything though, it's all discretion. They probably thought Chris was more culpable than Barb and only filed against him.

The other common time this occurs is statutory rape cases where two minors who cannot "legally" consent have "factually" consenting sex together. Prosecutors will only charge one party (usually it is brought to state attention by parents who find out about it) and use the other as a witness. The ethical morality of charging like that is dubious IMO but it happens and is legally allowed.

The GJ may just be/largely be a procedural tool to keep things moving as needed from a legal/justice perspective, as there's clearly a strong focus on his competence and/or whether he was legally insane at the time of the offense. Yes, those are two different concepts and standards, but there's clearly a lot going on behind the scenes relating Chris's mental state. And fwiw, Richard Bonnie, who is a professor at The University of Virginia School of Law and the Director of ILPPP, is one of THE leading lights (and has been for decades) in the universe of mental competency of criminal defendants (also on drug abuse and criminality, but that's less relevant here).

This isn't being handled like a run-of-the-mill situation (even a run-of-the-mill incest situation, if such a thing exists). Chris remains exceptional.
