Sorry if this has been addressed but what are the odds that this is “just” making good on the threat that should get a rational person to agree to a plea deal instead of an escalation on the part of the commonwealth? How likely is it that this is a result of Chris going rogue at the last second and rejecting the “time served” deal most people expected?

It's entirely possible. If Chris was being pissy, and either refused the deal, or fucked up in court when actually asked to plead guilty and instead tarded out about how he didn't really do it, it would pretty much force their hand. Jailing someone on a felony without an indictment is generally considered not acceptable. (Though Mississippi seems to get away with it.)

Apologies, I should have been more clear. I was talking about the actual court case where Chris takes the plea. But thank you for information on the grand jury indictment process. I am not aware of a lot of the rules around that.

In Virginia they let you out of prison after completing 80 percent of your sentence and the remainder is probation. So Chris could be in prison for 8 years in that case.

Probation and Parole requires you have a job and you pay for your probation and parole. So if they give Chris probation, he'll just end up in prison because he isn't functional enough to handle having a job.
