There was no balloon to pop, he's always walking on his last legs since the Sidescroller incident but refuses to kneel because nobody cared to make him kneel.

You can't restream Kick partnered channels. Phil is Kick partnered. He's way less safe there than on YouTube.

No literally the Klein ruling says you can stare in the camera and say "I am doing this to steal this persons content and deprive them of money" and that's enough to transform it. Fair use is a rape gnome now. Anyone smaller than a minor corporation can just get infinitely fucked up by it.

Phil, in terms of income, is nearly at his lowest in years. He is dependent on 2 whales, who have a ton of sock accounts. His marathons are the lowest they have ever been. His viewership and footprint are the lowest. I was surprised the Amabump died in 10 days; I thought it would see him to the new year. He made a lot of money from the Casino over $50k. He is on fumes atm.

He gave Raw a free win; Eddie on Kick dislikes Phil and gets on well with the Casino. Raw being there gives him a fun chat but also protection. I have a feeling he is going to aim for Wpig, but it is too transformative. Meerkat and Alt operate on Kick anyway.

If Eddie went full on Dan Clancy favoritism mode and partnered Raw Phil it would be one of the funniest moments in DSP history, the meltdown would be astronomical

I feel like that defense would cover a restreamer like Tevin, Alt ect. As were Raw is just a that a raw rip however that doesn't mean another wont popup just like raw did after darkdaves raw got struck originally
 
If there's an argument to be made in favor of Raw Phil as "transformative", it could be argued that it's a live archive that provides accurate context and more freedom to chat while also making viewers aware of just how dishonest Phil is without verbal commentary. The scrutiny is there, and interpretation is largely given to the audience. I don't think it would pass muster, but it would be very funny if it did.

  • Date and time so viewers know exactly when Phil was doing what and can observe patterns in his streaming or keep track of timestamps for making edited content. Also because he lies all the time and takes forever to do stuff so you can't trust his word for how long he intends to do stuff.
    • Looking at the time, especially on podcast days during the day streams, you can see he tries to start games close to 1:30-2pm if he can get away with it, and usually ends streams at least 15 minutes early to do Pokemon cards. You can also look at his "overtime" as an observation of stalling/desperation for last-minute donos.
  • Weather so you can gauge about how hot Phil says it is in his ahffice when it's 65 degrees outside and how sweaty/bitchy he will get about 'full sun'.
  • YouTube viewer count to determine Phil's metrics for "good attendance" and also note patterns in audience decline.
  • Visible Kick and YouTube chat for determining what is said versus what Phil says, and accurately show the discrepancies (for example, it's the same rotating cast of a couple dozen people at most on YouTube and a lot of the same regulars on Kick while Phil claims he gets totally different audiences of hundreds of people for different game genres).
    • Visible YouTube chat feed also means you get a sense of what Phil views as acceptable engagement levels before it gets too slow and he starts crying that no one's talking to him or handholding him, nevermind that a chat feed is only a fraction of any given audience on any stream.
    • Phil's not really one to talk, though, since he often has long pauses without commentary while streaming games. He should grateful the bar for transformative content is so absurdly low that how annoying he is and how badly he plays is technically commentary on copyrighted material. His reliance on chat is one of his worst crutches.
  • Goal tracking with audio cues (trumpets) and referential characters (Jasper, Khet, rabbits, Hogans, etc.) to convey whether or not Phil hit his tacit $150 goal.
  • Referential audio cues during DSP Tries It when he eats like a gross toothless weirdo cramming fast food in his mouth (DUHVAHWER)
  • Community engagement with fighting game streams
Like I said, shaky at best. But an argument COULD be made and that's funny.

It is more of I don't want thread tourists coming in and saying the usual "DSP is based and did nothing wrong" "Detractors are worse than Phil" "Who cares about a Let's Player" etc.

It's all so tiring.

Would be pretty funny seeing the retarded tourists twist themselves into pretzels when they'd start to claim that wearing diapers is BASED actually and that Phail has actually become a RIPPED MUSCLECHUD and that a GLP-1 drug hasn't even been within a 5000 mile radius of the KING'S CUT AND SHREDDED PHYSIQUE.
